Ex says he isn’t working, CSA takes his word for it
My ex partner and I planned to have my son but he decided to change his mind when I was 5 months pregnant and I haven’t seen him since.
My son is now 14 and I have been trying to get money from the ex for 6 years now, but to no avail – firstly he denied my son was his but we did a DNA test to confirm he was his, now he is stating he is not working and not claiming. The CSA are stating that they have to take his word for it. Any advice please?
I am really struggling to make ends meet and can’t do anything more than work full time, do a cleaning job and car boot sales.

i doubt they would just “take his word for it ” they would have done the relevant checks with hmrc to see if he was in employment
They would have done the hmrc checks but i am also in the same boat, what I have found is that I never speak to the same person at CSA and my ‘case worker’ changes regularly. The decision as to how the case progresses depends solely on the ‘case worker’ in charge of the case at the time. The problem i am having is that it takes weeks and sometimes months to recieve word back on if my sons father is working, then it takes weeks to hear back from his employer, then they need 2 months of wage slips to account for how much he should pay – depite the fact that he has nearly £2000 in arrears already in the space of 18 months that they have been chasing him. so far in 18 months through the CSA, jamie has, quit one job after 2 payments and dropped his hours at another to only earn £23 a week and NOT recieving any benefit. I have been told that they wont take away his liscence, send anyone out or take him to court because they dont think they have the corrct address for him and wont punish him for avoiding the CSA! THIS IS WHAT A CSA AGENT TOLD ME! meanwhile….he can drive around in his van, work on the side, claim to everyone else that he is supporting my son financially and gets away with job hopping and paying NOTHING! And my taxes are paid to a company that dont enforce what they say they do, is awfully run and hires people that dont give a shit! if you find a way forward from this, please share because so far, i feel lost in all this and I feel like there is no justice for my son at all! I hope it works out for you
i have the same problem. A woman from CSA this morning told me they will take my exs word against mine as he has no reason to lie!! They also told me that I have to do the investigating. I have to follow him and I have to log the hours he is working to prove to the CSA that what I am saying is true!! I would but I have a child to support and he lives 200 miles away from me. they also told me that they will not look at his national insurance number unless I have definite proof. My ex is self employed too so the CSA said that he does not have to declare all of his earnings.
My husband is self employed.When i moved in 8 years ago he had his son living with him while his daughter lived with her mother.No monies were paid has each parent looked after and claimed benefits for the child that lived with them.Move on 6 years and his son leaves home,ex puts claim into CSA for my husband to pay her( son left us in debt due to ex keeping him at her house and us claiming tax credits while he should have been at college).We had days to sends in forms ,tax information and left with letters saying they would fine us if they werent sent back yesterday.The CSA took our tax credits into account and worked out the amount we had to pay.We ended up paying her £240 per month while she claimed all the benefits she could ie Child Benefit x2,WTC,CTC,Housing Benefit,Poll Tax Benefit and our CS and another CS for another daughter.Not all NRP work the system.
Write to your mp and explain your case. Write to the person in charge at your csa department and explain that you have written to your mp. You will get a call back and hopefully some help with your case.
Actually the words I was given were ‘we have to give him the benefit of the doubt’!
