Ex paid money to CSA but CSA has kept it
My ex has been paying the csa for years, we split up in 2003, I received my first payments in June 2012, for a years worth of payments, not bad considering we split up in 2003 and he has been paying for years, when I contacted them a few years ago I was told my case was closed, even though I never closed it. so I had backdated payments for 8 months or so in June this year and payments from them on.
Two months ago I got told I had been overpaid by £600, I was livid and since then I have had money deducted from my payments (what an insult considering they owe me years worth of payments) someone had made an error with calculations and I am still paying for that. I have made numerous complaints, which I was advised to do, but nothing has been resolved.
There are thousands of pounds unaccounted for, although I am not the only single parent with this man. One other case linked to my kids dad, was getting £425 a month for a 19 year old daughter (who currently has her own son), yet I had nothing for 2 boys under 15. I am now paying back money I have never received, there are thousands of pounds he has paid in unaccounted for and they will not give me or him any answers.
If this was any other company it would be classed as fraud, I am so disgusted with my treatment, but cannot do anything about this. I complain non stop to be fobbed off each and every time! I am now going to write to my MP because I don’t get any answers from the csa and it is not fair that they take money under false pretenses!

When did your case commence, before or after 03/03/03?
Was the other case, for the older child, opened before or after yours?
Were you in receipt of benefits?
A full benefit disregard was only introduced in April 2010. Prior to such a PWC on benefit received, depending on which set of rules their case was on, little or nothing of the CSA paid by the NRP.
You could apply for your Data Protection File, along with a complete account breakdown and all note pad sections to be dated – there is a £10 fee.
Once in receipt you should be able to establish what has been happening with your case and be able to base your clearly marked, written complaint (copy in your local MP) on factual evidence contained within. Keep copies of everything you send and post signed for.

Dont deal with the csa by phone. Put everything in writing, send recorded delivery, keep the receipts. Get a copy of your Data Protection Prints (£10) ask for everything, computer prints and written notes. Make a formal complaint and start an appeal, there are time limits involved. Get the ‘independent’ csae examiner involved but get your data prints first. Do get your MP involved, they cant force the csa to do anything but can advocate for you. If you get no joy with the internal process your MP can progress your case to the parliamentry and health service ombudsman service. (but you need to exhaust the internal csa complaints process first)
The csa is a branch of the DWP, the ‘independent’ case examiner is part of the DWP, the appeals tribunal is part of the DWP so dont expect much.
My own view is that its just a big con to collect stealth tax to pay for the non jibs in the DWP like the csa, but thats just my view.

I have been making formal complaints, that was the only way I could get a payment, I am currently on the second stage of complaints, I was told by this complaints department my case was never opened, because they could not locate my ex, but I know at the time he was paying them, my ex has proof that payments were made years ago for my 2 boys and yes I was in receipt of benefits back then, so that would explain why I never saw the payments. I am waiting for this complaints to wrap up yet another fob off to me, before I can go onto the next stages of complaints, but this stage was a lot less helpful then the first complaints department I dealt with (confusing I know). I get fobbed off and I know the CSA are covering up a big mistake on their behalf.
The other cases were opened before 2003, I have loads of emails from complaints that went unanswered and letters from various complaints departments, where do I get the data protection file from? Thank you for all the great advice it is appreciated.

Once in receipt, the CSA will have 40 consecutive days to supply such. A complaint can be made to the Information Commissioner if they breach such.
