Ex claiming CSA when daughter never lived with him

My ex claimed child benefit fraudulently for my eldest daughter who has never lived with him as he was abusive towards her. I also have a son who lived with me and another daughter who lives with him. He earns i excess of £60,000pa I earn £10,000 pa at the most. Because of his claim I am in debt with the CSA for £3,300 even though legally I do not. My daughter has done a statement infront of a solicitor and was willig to stand up in court to state she has never lived with him but they were not interested.

To top it all they sent out a court summonds, but instead of sending it to me they sent it to someone else. This had my Name, Address, date of birth, NI number, details of debt, my daughters name and date of birth. I have been fighting this for 6 years now, have contemplated suicide on many occaisions especially when Marstons pay me a visit. They are a sham and break families up instead of helping them.

  2. My ex claimed child benefit whilst my daughter was at college. I didnt realise I could get it untilthe college told me, when I claimed I was told my ex was already claiming. I informed them she did not live with him and years down the line nothing has been done. My daughter has done a statement infront of the solicitor and even went to court with me willing to give a statement but she was not allowed. She is 23 now so age is not a problem

  3. The arrears are for my youngest wholived with him, but at the time the arrears came about I had my 2 eldest that I was supporting so really he should have paid me. as I said i was earning about £10,000 and he was on excess of £60,000

  4. Yes you should have claimed CM via the CSA for the children living with you. Do so now if you haven’t already. It will only be a future liability of course.

    You remain liable for the CM arrears for the child that lives with him and your claim that legally you don’t appears wrong.

    Did he actually claim CM via the CSA for the eldest child as the title of this thread states?

  5. The CSA do not break families up, they do however profit from broken families. The CSA are happy to cause disputes in broken families andte only people the CSA wish to help are themselves. Itis the broken families that help to supporttheir wages. If only everyone of the CSA's employees were aware of their actions and the amount of suffering that their actions cause to our children, maybe tey may find the courage to seek other employment, however! the CSA employ cowards who prefer to hang up when you havea dispute wit them rather than listening and providing help!

  6. Well, they have broken up second families Allan. There aren't many second families who can deal with the stress 🙁
