Do the payments depend on earnings or is it a set amount?

My son was married with two children aged 6 and 10, his wife left him for someone else and my son gives her 80.00 per week for the two children. Pays it every week.

My son has the children every friday evening until saturday evening every week and takes them out swimming etc spending anoter 15.00 roughly and feeding them. His ex wife sometimes makes demands on him to buy the children clothes and shoes, he tells her to take it out of the money he gives her but she said its for food although she has had nother babay from the new man, he is employed and on a basic week earns about 25,000 a year but he has a mortagage and has to live himself.

How much should he pay per week and does it depend on what you earn, or is it a set ammount for two children

From my experience this is a common statement along the lines of ‘it only covers the basics’…wrong wrong WRONG!. if you pay via the csa or any payment plan you should not be expected to pay any additional monies unless you have agreed it. Payments are calculated at a fixed rate normally which is dependent on the amount of qualifying children which I believe in your sons case is 20% of takehome pay….https://www.gov.uk/calculate-your-child-maintenance …this link is for the UK governments official calculator.

It’s 20% of take home pay but he should get a reduction of 1 seventh for each night he has them sleep over.I’m presuming from age of children he is on CSA2.If the pwc will admit to the CSA he does.Some pwc’s lie about it because they don’t want to lose any money & guess who the CSA believes!!Some nrps have had to resort to taking photos of the child holding the daily newspaper like you see on films & keeping a diary! Do they not think the nrp needs to provide a house (with enough bedrooms )to see the children in & live & feed themselves & run the car to get to the JOB that pays for all of this !!!
    This 20% should cover all daily maintenance -the NRP wants a little left to save take the child/ren out on their Birthdays & buy Christmas presents!! Obviously they(nrp) can buy what they think the children need & give extra if they want to but this CM is supposed to take account of the need for school uniforms etc. The family of the pwc will probably have both tax credits & also the Ch/Ben as well as new husbands wage.
    We are caught in a case where they are taking 30% of my husbands wage -we have paid pwc have all the proof of the money going to her by DD but she is admitting it & CSA believe her !! WE are having to prove she is being truthful despite over evidence .What happened to good old British Justice..innocent till proven guilty which should apply to us !
    What does the pwc in your sons case feed her children on ,we barely have that to feed 2 adults & our 2 dependent offspring in a week ?Child Support (..wry smile )not for the children that live with us !!
    CSA please be reasonable !!

  3. Suggest your son goes to the CSA himself. By the sounds of it, he’ll be better off.
