Deadbeat ex claims 15 percent of my wages

My daughter decided to live with her father because I became ill and had to have a hysterectomy.

It was agreed she would return when I got better. My ex poisioned her against me and she refused to return home. He gained a residential order. I paid him 50k settlement when we got devorced, I signed a business over to him and agreed to pay all the family debts.

I now have to pay 271,00 for the debts and I have a mortgage of 890.00 per month. My ex mutually agreed not to claim from the csa, now he has changed his mind. All my marriaged life with my ex he never paid a bill. He is irresponsible with money and fritters it away he doesnt work and claims full benefits and I have now discovered he can claim 15% of my wages which will be at least 300.00 per month which I really cant afford.

I feel I will have to pack in my job and become a drain on society I live on my own what can I do to ease this situation by the way he is doing cash in hand jobs as well I think the system stinks.

  1. Do you have your daughter stay over at yours ? 15% is minimum they will take. But the csa take that long in processing claims they gonna slap you for arrears which is normally another 15% total 30% till arrears are paid of. Sorry for bad news but you need to be prepared because the csa is run as a business and with no regard to anyone’s well being. However if you have your daughter for more than 3 nights or 3 nights a week it’s unlikely he will have a claim. If your ex is getting cash in hand get proof and approach your mp. Keeping every document and forwarding into csa. Ask for your case workers name and only speak to him / her. Follow every phone call up in writing to them cause beleive me they only hear what they want to hear. Hope this helps you.

    Did your daughter’s father pay child maintenance when your daughter lived with you?

    If the CSA become involved they can take into account some types of prior debt resulting from the relationship. You would need to apply for a variation.

  3. for 1 child the regular maintenance will be 15% of your net income – you will get an allowance for shared care if your daughter stays overnight with you, however even if she stays with you 3 nights or more in a week you will still be asked to pay, the maximum you will get for shared care is 50% plus £7 and that is if your daughter stays with you 50% of the time. If you can prove the debts were for your husband – ie car finance for a car that he kept etc you will be able to apply for a variation but the divorce settlement will not be taken into account

    To save yourself a large arrears amount building up start making payments of 15% of your income now or put it aside so that when the calculation is done – it can take time as they will need to wait til you are able to provide 2 months worth of wage slips – you can pay a lump sum towards the arrears
