Daughter’s ex owns 5 cars and is rich, pays nothing for his 3 kids

My daughter was divorced 6 years ago. She has 3 children, now aged 17,13,10.

Her ex has never paid any maintenance. His claim to the CSA was that he earned £500 per month from his garage business. In fact he employs his wife in the business and pays her £50K per year.

His life style is lavish – he currently has 5 cars (including a Lamborghini and a GTO); his step children all have plasma TV’s in their rooms, the latest everything.

When my daughter was diagnosed with breast cancer he told the kids he hoped she’d die quickly!!

I’m writing this because my daughter is emotionally unable to continue talking to CSA, and because I now find myself using my pension to give her children an adequate lifestyle, thereby indirectly supporting the lifestyle of my daughter’s ex.

    I note your daughter is having difficulties dealing with the agency. Could you or another member of your family, or possibly a close friend, be in a position to deal with them on her behalf?
    If so your daughter can contact the agency (in writing) and inform them of the persons details and that they have her permission to deal with the case on her behalf.

    If your post is correct, your daughter could apply to the CSA for a variation on the grounds of Diversion of income, Life-style inconsistent with declared income and possibly Income not taken into account and Assets.

    It will give you invaluable information regarding applying for a variation and descriptions of the grounds that can be include.

    Your daughter may need to provide some evidence (the more, the better);

    Information about company shareholders can be found on the share register of the company, a public document held by the company registrar. Information is also held by an organisation called Companies House.

    Land Registry hold information on property ownership.

    If the CSA refuse your daughters request for a variation, this then gives her FULL appeal rights and means she has the opportunity to apply to an Independent Appeal Tribunal for a Judge to decide if her appeal can progress. She should appeal the CSA’s refusal within the first 28 days.

    Be careful accepting assistance from fee charging companies. If you do require their services, be sure to try and establish a no win no fee agreement and fix a total amount prior to their commencement with the case.
