Daughter no longer living with mother but she claims CSA for her

I found out 4 months ago that my 14 year old daughter was no longer living with her mother who is still claiming csa and child benefit. I informed the csa who assured me they would persue my ex and I would be due a refund from the csa. After hearing nothing for 6 weeks I rang the CSA who asked me for more information as they had no way of investigating the issue.

I explained that if I was the one who was seen to be pushing this my ex would use this to further demonise myself to my children, I am just building a relationship with my children after 10 years of not seeing them and don’t wish to jeopardise this progress.

Both the Csa and social services have said they are unable to help, so here we have two state agencies being complicit in fraud and unwilling to address it. Any suggestions anyone.

  1. Steven:- You need to contact the Child Benefit Agency and tell them what you know.
Then contact the CSA and ask them to check if it is still in payment to the parent with care.
The CSA can do nothing as long as child benefit is paid to the PWC.

  2. If your daughter is no longer living with her mother but the mother continues to claim CB for her then she is claiming this fraudulently, the legislation the csa work by states that if CB is in payment the person receiving this can claim CM through them so unless you report the mother to CB for fraudulently claiming your CSA claim will remain open and you will be liable to pay your current assessment.

  3. Another example of the CSA not letting the facts get in the way of a good source of income, they have many ways of recovering money owed to them but not interested if fraud is happening. and very slow at returning money collected in error.

    Not necessarily !

    Steven,

Can you confirm, who/where does your daughter live now and does your ex contribute towards the child’s upkeep?
