CSA taking money even though ex does not want it

I was married for 12 years and had a daughter who is now aged 19. I left my wife after 12 years of marriage. After she had an affair with a work collegue.

My daughter was 10 at the time. After I left I agreed to pay the mortgage and £500 a month to my x wife which I thought was very generouse in the cicumstances. It was payed on the agreement that I would have total access to my daughter.I love my daughter and wanted her to have everything she needed. The 1st couple of years after the breakup were stressfull. My X decided she wanted to sell the house, to move on. With which I agreed and the house was sold and divied between us. I still payed the £500 a month and had no dealings with the CSA.

My x remarried. Then informed me in the June that at the end of July she was moving to the states. One months notice..!! The worst part was she new she was going in the Christmas 6 months earlier. I told my parents and that was the 1st and only time I have seen my Farther cry.

I stopped payments as agreed as access was lost, she moved to the states for 4 years and for the last 3 she has lived in Mexico. She does not work and her new husband has a good job and supports her.

I had a near breakdown and found coping with life a struggle. I went travelling to sort myself out mentally. On my return I opend a new bank account, got back into work and started to sort my life out. This was when I 1st heard from the CSA. Saying I owed them £2000 for non payments. I had never contacted the CSA and did not think I would have to make any extra payments.?

Oh I now remember how the CSA contacted me, they only had my parents number and phoned my mother. Telling her I had died and they needed my postal address. Lucky I was in the same room as her at the time..!!!

They told me my x had contacted them when I moved out and they had started making payments. I had to prove I had been making the £500 a month payments to my x. I contacted the bank and had the 18+ months of old statments printed off. Forwarding them onto the CSA.

2 months went by and I contacted them again asking what was happening… I was told that the statments had never arrived and my file had been lost. My mistack was not to have made any copys. Once again I contacted the bank had another lot printed off and this time with the help of registered post I sent them of again to the CSA.

I was then told they had arrived and my case was being looked into. One month later I phoned to be told they were going to refund any monies owed to me and then investigate my x as she had never informed them of the payments I had made. It turned out she had claimed everything she could from the council and the CSA. Who un-known to me had been stopping payments from my account at sorce up untile the time i had started travelling. Another month past and again I phoned to ask what was happening.

The answer came as a real shock to me… They were not, yes not going take any action against her as she now lived in the US of A..!!! And I still owed them the £2000..?? As this in their words it could not be written off. No refund would be sent to me. The women at the end of the phone appologised and said I was just one of those poor fathers that the system had let down. I told them where they could go.. It was one of the lowest points of my life. I thought I was being a good supportive father. Making payments and being honest only to be let down and treated like a criminal.

A few months later I was told over the phone that no action would be taken due to the dept and circumstances of the case. I asked for this to be sent in writting….. no bloody chance. Two years later the phone wrang again saying that I now owed them £4000, as they had still been making payments to my X. I contacted my partner who then informed the CSA that she did had not been reciving any payments from them and did not want to have any monies from them. Then we both asked for a breakdown of the payments and where they had been sent to…. Funny she or I never heard from them.

Then…

8 months ago I had a phone call from a dept collection agency who were working on behalf of the CSA, saying I now owed over £15000. I told them to send me a break down of the case and monies owed… Funny I never heard from them again.

Than this week the phone rang….

Dear Mr Jenkins we have a business oppertunity that we would like to discuss with you… Hmmm I phoned the number and yes you guessed it, the CSA. Now I owe £7000..??

So what do I do my x now lives in Mexico does not work, has not received any payments from the CSA and after telling them more than once, does not want any payments from them.

Today I received a letter saying £7584 is now owed.

  1. Why is it always different the amount I owe..??
  2. I would be happy to pay if I knew where the payments had been sent too
  3. Had a break down of the payments as i feel this is only fair
  4. Why should I have to pay anthing from the date of my daughter moving to the States and then onto Mexico..??

My x was not employed in the govenment or in the military. She works as a hair dresser..??

The CSA are just scum.

  1. my god… take them to court… win because their system does not collect on behalf of non-uk residents!!!!!!!!!!!!!!

    I have spoken to the CSA, who tell me that even though my x works as a hair dresser. Here new husband works in the diplomatic service I am still liable… I told them I have a friend who is unemployed so using there logic I do not need to pay any monies owed.
