CSA still wants money even though child lives with me
I left my daughter’s mother 12 years ago when my daughter was 3 years old, up until that point I had looked after my daughter whilst she was working nights along with dropping her off and collecting her in the early hours and dropping my daughter off at a child minders. I decided to call it a day as I felt is was better for all parties involved when she tried to stab me in front of my daughter. I left the house with no possessions and agreed for her to take over the mortgage which I was paying half towards for sometime afterwards. Access was then very difficult and when I did arrange to see my daughter she would ring the police to say that I was trying to break in. I spent alot of money trying to gain access to my daughter and agreed to make payments and could see my daughter then on a weekly basis, but not over night. The usual events then took place, my daughter would be ill, not available not convenient…
I have continued to have a relationship with my daugter over the years and again took her mother to court as she planned to take her out of the country to live, this was blocked by the court and I was granted parental responsibility which was declined in the first round along with 1 weekend a month for visits.
She then went to the CSA which is when the fun started…. bearing in mind she was involved in 10 business that all went into receivership and the banks wanting to pull loans against the house circa £750k my CSA money did not go to my daughter but for sure went towards paying the arrears on the debts.
Eventually my daughter now 15 has had enough of being treated like a second rate citizen and requested to come and live with me, which she has now done so for the last 6 weeks.
I left it 3 weeks to make sure that her decision was final and explained the process and hassle that may be caused in trying to reverese the CSA payments to allow me to look after her properly and ensure that she gets the money that she has missed out on over the years, she was happy to stay.
I contacted the CSA to confirm the situation and to request for my payments to be stopped, they requested for me to contact Child Benifit as they could not stop the payments until child benifit acknowledge that I am now looking after my daughter (this can take up to 12 weeks)and payments will not be stopped or held…!
I was also told that if I wanted to counter claim it would be from the point that I informed them of my daughter living with me and 6 weeks later I am now told that it would not be until they have confirmation from child benefit, so my daughet loses out again. They don’t care a jot about my daughters situation they only seem to care about the easiest route to the money and their statistics. I would also like to comment that I have had nothing but bad service as both a payee and a claimant and had to get my MP involved previously as well as contacting the manager directly as she gave out her mobile number by mistake…If I find it I will post it for all to contact directly…..AAAARRRGGGGHHHHH! Can somebody that has had a proper job outside of the private sector take control of this shoddy operation?

As far as I am aware the receipt of Child Benefit should only be utilised as a deciding factor where there is a dispute between the parents over which is the PWC, ie care is equal. If care is not equal who received the Child Benefit doesn’t matter for CSA PWC purposes.
Is your ex still claiming to the CSA that she is the PWC ?
Yes, I believe that she was advising them that she was still the parent with care, after many phone calls to both the CSA and Child Benifit, I have managed for child benifit to be awared to me. I have stopped the direct debit to her mother and have not heard anything from the CSA, some 2 weeks after Child Benifit was awarded. They confirmed that they would let me know the outcome by the end of the week, 2weeks ago and I am still waiting….How annoying is it that as tax payers we are actually paying these morons who seem to be devoid of doing the right thing…
Same for me to, same situation but in a lesser time period.. and I bet the police took the womans side, even thoiugh you was the one stabbed… told to well` youll live' this really stricks a cord with me, even with a stileto in my head… told to get out of my house…! once told to take my child too… !! and had to sleep in the car.. But yes, what there saying is right, so get onto it , all including … child tax credits, child support, everyone, your mp will be as much use as a mother in law on your honeymoon.. So.. get them, recorded details to them, as every conversation has to be documented, keep your own diary to give exsact call dates back to them, when and who you spoke to, do this daily… and i mean daily, they can back date this to four weeks.. but really, you have nothing.. no proof.. even a child court order, … your child now is entitled to be a free representative, so can ask for her own legal help, to which you can involve a letter by her soliciter to you and the benefits, so now, ive given you what you need, so please move.. and when you call the csa… just listen to how your treated.. there expecting you to make a payment.. they will ask for clarification every time.. ! colin
and please, dont forget, your daughter has come back, make the most of it… money is not the be all…
