CSA spoke to me like shit and didn’t care we cannot afford their demands
At the moment im going out of my mind as i really dont know what to do or how me and my partner are going to live.
At the mo i get £50 p/w from my self-employment and £88 p/w tax credits for me and my partner, she does not work at the mo as she has just left Uni and is working voluntarily as a teaching assistant to get some experience, So all we get is £139 a week for the both of us to live on.
I have been paying £15 p/w for my son without any problems and have just about scraped by and never had a case with my daughter as i see her all the time and buy her stuff when she needs it, But out of the blue yestarday i had a letter stating that my £15 had now gone uop to £19 and that i was in arrears buy £1065 for not paying for my daughter!
When i rang them an d asked how this could be, they said that my daughters mother opened a case against me last september, and i should have been paying, this was the first i had heard of this, no letters or anything.so they now want me to pay £10 a week to bring the arrears down, making it £40 in total to pay each week.
Our out goings are £129 per week leaving us with just £10 left over, if if pay £40 per week we would only have £99 to try and pay the bills and live on for the both of us, i worked it out and found that we will soon fall into debt. The guy i spoke to on the phone treated me like i was sh*t, would not listen to anying i had to say, just kept threatening me with court action if i did not pay up… These ppl act like terrorists. Can they still take so much when half of the tax credits are for my partner?I feel like just going on the dole and sticking 2 fingers up.

Make an appointment to see your M.P. The CSA are bound by rules and regulations. They can take 40% of your income at most.
Write to Duncan Smith at the DWP and tell them how you are being treated. Where possible name the staff who were dealing with you and make a formal complaint to their bosses.

Macwalsall:- Because you earn less than £200 a week you are being asked to pay at a reduced rate which in your case is £15 for one child and £19 for two.
That is £19 a week maintenance and £10 a week arrears making total of £29 per week.

Even though there was an existing CSA case for your son, the rules are still the same and a case for your daughter would be effective from the date the agency first made contact with you regarding such.
It’s important you establish how and when the agency consider they made their initial contact with you regarding your daughter’s case (could have been by telephone or in writing).

I have now sent a letter asking for all the information they have about me, including all letters sent to me and all electronic data.
if the WTC are paid based on you being the primary earner then this is classed as your income and will be used as such for the maintenance calculation.
CSA can take up to 40% of your earned income, they cannot take a deduction from your WTC so on £50 pw the most they could take is £20 per week.
You should have been contacted when your daughter’s mother contacted them to advise that a case had been opened, if they were unable to contact you by phone they would have sent a Maintenance Enquiry Form (MEF) to the address they held for you on file, if you did not respond to this they would have presumed parentage and proceeded with a new calculation. This would be effective from the date they sent to MEF and a Maintenance Calculation letter would have been sent to the address held on file.
My ex opened a case in 2001, the CSA told me in 2003, 9 years later I got the £7k arrears letter. no mention from 2001 to 2010 then my payments go through the roof/ they are worse than dumb.
