CSA rules on a joint residency

This is an unusual one but I left my ex husband 8 years ago and divoreced him on the grounds of un resonable behavier.

He then put the family allowance in his name as I was NFA. although I paid for the house and pciked my son up everyday.I then found a house round the corner from my son and within a couple of months recieved a letter from the CSA.I went to court to have a joint residency put in place so my son has 2 addresses.

Although I have done this CSA do not recognise it and I still have to pay him £67 per month. This is stupid as not only do I pay for my son when he is back home I have him I pay my ex aswell. it seems un fair and stupid.I have another child on the way and worry about the CSA.

Please help

  1. Whoever collects the child benefit is going to recieve the child maintenance, when you have joint care.Unfortunatly it is you the mother that has to pay CSA,it could easily have been the other way round. It is not unusual ,it is usually the father who gets the short end of the stick. Can you come to an agreement without the csa being involved. It is not fair if you both have the child 50/50 and you both have the same outgoings.Your ex is getting an extra £20.00 a week, maybe you think that £67.00 is a lot but there are worst cases on here that show it is very little. If he is having the child on is own then yes pay him,as you say you are having another child so must have a partner that supports you.I am a NRP and a PWC and i pay just over £120 a month ,get nothing from my ex for the son that lives with me.Try talking with your ex and coming to an agreement,if not then yes you will have to pay but it will get reduced when your new child arrives,Good Luck,The CSA has never been fair and to them we are just a referance number and nothing else.
