CSA refuses to give a breakdown of arrears

November 2, 2012

The CSA are after Secretary of State Arrears totally £2500,we are disputing this because the debt is 19 yrs old and and under the statute of limitations/2000 yr deadline, ( I believe this because my husband had a full and final settlement with his ex in regards to the information above, therefore setting a precident for the secretary of state monies.

The CSA are refusing to give us a breakdown of the arrears, which would prove the time-frame, they have also put a DEO on my husband. I recall from dealings with the CSA that they cannot get a liability order, because they cannot go to court, being that it is over 6 yrs old, but the threats don’t stop coming. I have written to my local MP to help with this and will go to ICE and a Child Maintenance commissioner, if I am able to.

Should my first step be to ask for an appeal?

I am totally consumed by this situation at the moment and worried sick about the powers the CSA have, so any advice will be extremely helpful

The CSA done away with the 6 year rule in 2006 which means they should not be chasing a debt prior to 2000, but unfortunately they do, more so if it is due to the Secretary of State. As you say it cannot be enforced through a liability order but I feel the CSA are abusing their powers with the DEO and recollecting monies in this way. When there is a debt due to the Secretary of State this money is collected last. When did your husband stop paying ongoing maintenance?

Have you obtained a copy of your file from the CSA? You can contact the Data Protection UNit, CSA, Newcastle and for a small fee of £10 they will send all paperwork they hold. They have 40 days to provide you with the file. When my partner got his file we really could not believe what we were reading and it has helped us tremendously with our fight with the CSA.

You have to exhaust the CSA’s own complaints procedure before going to appeal. Get your MP involved as this will get things going slightly quicker and you will have one person to deal with which will save you going over things time after time if you call. Put everything in writing with the AGency so it is easier to keep a track of matters.

We requested a statement breakdown aswell. It took 10 months to get it. Once we got file it seems CSA were not keeping their records up to date and it took them 10 months to prepare the Account, despite sending letters saying my partner was due £39000!!

My daughter left school in Aug 2012 and is now in full time employment. My final CSA payment was in August as she started work beginning September. CSA have now contacted me to advise that The case is now closed, however, after reviewing my account, I’m in arrears of £291+. I have made payments religiously via standing order or if a payment was missed, by card. So how can I be in arrears?
