CSA paid money into someone else’s account for 14 years
I have received a letter this morning (29th june 2011) from the CSA stating that as of 3rd March 2011 my child maintenance payments will stop on the grounds that” the qualifying child no longer lives with you”. Now this is bloody clever on two accounts, 1) my daughter hasn’t gone anywhere and still goes off to her college course every morning, she has no intention of leaving home and intends to return to college next year and 2) i have not received one penny in maintenance from the CSA in the 15 years since I divorced her father on the grounds that he was having an affair with a woman “unknown”.
I already came away from court with nothing, he kept the house etc, paid me nothing and the only order granted stated “no order has been made” i have struggled to stay in one place bring my daughter up on my own and any money the CSA did get off him would have made a big difference to the hardship we have lived through.
My daughter and I are now in the process of eviction from our home, repossession was granted sept last year. we have been back into court every 28 days for nearly a year trying to stay the eviction in order to apply for mortgage relief which still has not been granted.
The CSA claim that payments have been made into a bank account – who’s we dont know – it certainly isn’t mine, I have been told i will have to pay £10 ie buy my way round the data protection act if i want that information ( surely that’s not right data is protected for a reason).
If payments have been made and i have been kept from them, all the hardship my daughter and i have been through could have been prevented.
The CSA have been negligent and have acted incompetently and i feel we have suffered as a result of that. Surely my daughter has a right to make a claim for damages based on the fact that had she been in receipt of what is rightfully hers she would not have had to go through this living hell?

Have you received any letters/communication from the agency over the period?
You can request a complete account break down from the CSA (should not incur a charge), which will show all payments on your case that the agency have received and paid out. You should also escalate your case to an official complaint.
It’s up to the CSA to establish and investigate who’s account they have incorrectly paid the money in to. Contact your local MP and ask them for their assistance. They will be able to communicate and question the CSA and request information regarding your case.
