good luck with that they do not even pay back men that payed for kids that are not theirs .
Just keep phoning and writing to them. Emails are a good idea too. Dont be surprised if they come up with some bullshit excuse that says you actually aren’t owed any money or that you owe them money! Its been know on more than one occasion to happen. They don’t like paying money back to people. If they try it on request your data protection file. Its now free and it will give you all the info you need.
Well said Becky!
I was owed £900 I got £0 back now I owe them £2500+ in less than 9 months of them telling me I was owed money
CSA… do the right thing and pay back money they owe due to overpayment?… I am afraid madame, that you are in cloud cuckoo land!
i got my over payments put in my bank within a few days of being on the phone
Never contact the CSA by ‘phone. Get it all in writing (snail mail is best). It may take longer but any correspondence you do get you can use as evidence whereas a ‘phone call is useless for that. That said, I wish you luck my friend. The CSA are immune from everything you can imagine – mistakes, mal-administration, ignorance, incompetence. You name it. Even in law they hold the trumps.
In situations like this whereas there have been overpayments, I would write to the CSA, explain your account has been overpaid by x amount, you have tried unsuccessfully to recuperate your overpayments, give the dates and time of all the calls you have made where possible, (get all your outgoing calls listed by your phone supplier, they should be on record).
When closing your letter just inform the person you are writing to that you would like a reply within the next three weeks, failure to reply means you will take legal action.
There are two ways you can take action to recover monies owed to you, firstly you must have concrete evidence that these people owe you x amount, only then can you take the action you prefer.
1, You can apply for a claim by going through the small claims court, your expenses including loss of days pay to attend court will be also be included in your claim.
2, You can go direct to the Bailiffs, I am not to sure what their charges will be or if you can include all your out off pocket expenses, but they will explain very simple to you on how their system works.
Before you start your process in claiming back your overpayments, the CSA is an agency, you may not be able to claim against the agency, so, you need to do a little homework and research, you need to know the name of the person who is the head of the CSA branch that is dealing with your case, you also need to find the name of the person who is in charge of the overhaul CSA.
When sending your first letter to the person in charge of your CSA branch, also send a copy to the head of CSA, and keep a copy of all correspondence you send.
Please do not write those letters by hand, have them typed out. but you must keep a record.
Good Luck
Mr Nelson
