CSA keeps taking money for a child who is nearly 21!

I have 3 children to 3 different ladies!

Well the eldest will be 21 this september and been out of full time education since july 2010. Ok the final payment to this child’s mother should have been 19th of september. Unfortunately they have carried on taking 25% of my wages and not 20% to be dived to the other 2 children’s mothers.

I’ve spoken to 3 or 4 different people on the phone at child support agency and still haven’t got any further forward?! I have calculated 17 over payments that is owed to me, but my last wage showed a change to 20% but no reimburstment after 4 phone calls and still no letter of explaination!

Now i have to seek advise! where from? and with whom? my friend said go straight to your local mp. if anyone can get this issue resolved they can!!! so lets see shall we? or it will be a great selling story for the media then.

  1. Gagging order is ‘common purpose’. Look it up on internet. The media have sold their souls to the devil (government) in order to find favour on reporting positive political issues!

    My friend, go to your M.P. you are wasting your time talking to the CSA on the phone. Put everything in writing for evidential purposes.

    My opinion is that paying for a ‘child’ aged over 18 (a child aged 18, that’s bo–cks).

    Can’t wait for a breakthrough case in the courts that forces CSA closure!

  2. I would LOVE the csa to close down and have something fair and just and considerate set up instead. However, the csa wont close down, why would such a lucurative business shut up shop, when the dividends far outweigh the minority objections (namely NRPs and not many are going to stand in their corner other than their partners)

    Its simply a masterstroke of simplistic genius, pungent with sadism, which makes it even more tasty to our dictators.

  3. Possibly they found some arrears on your case and you have up to 2 years (debt steer)but then again they would have to tell you !We have had the pleasure of dealing with the CSA recently. We were in a private arrangement with the pwc( as she said we were ) but according to CSA we weren’t so have thousands of pounds of arrears despite not missing a payment to her !(work that one out ,we can’t!)and I have been reading up on it ever since we had the fateful brown envelope last year! I have read so many very sad cases like yours ,something has to be done for NRP’s in this position .We got £50 consolatory payment because the CSA took well over a year to process the case.We carried on making the private payments to her totally unaware there was a problem & none of this counts off the ‘arrears’!! Good luck with your situation.We have found that the media,solicitors,CAB cant help much due to the ‘common purpose’ thing as well.

  4. Ask the agency for a client statement and this will show you every charge on the cases and every payment made. It will also show you where, if at any point, you have been in arrears during the course of your cases. If there are adjustments on the statement these will be when a new assessment has been cone – if it is a negative figure this will be in respect of a drop in your maintenance liability for either a lower income or the closure of a case.

    With respect of your eldest child – when were the agency informed that she had left full time education, and was CHB ceased for her when she left education? You should have received a closure letter stating when that case was closed.

The CSA only look at CB when the NRP rings and demands it, they will keep taking as long as they can because they dont care as long as lots of money is passing thru CSA hands, you are in effect another statistic, not a person, CSA staff are trained robots, treat the mum like gold and dad like shit, take all his wage knowing he has nothing to fall back on just so the mum can live it up, i really hope you get this sorted,

  6. The agency only investigate any change of circumstances if they are informed of a change – with the exception of a child reaching the maximum age which automatically raises a closure task on the case.

    CSA clients – both NRP and PWC – are advised that they have a legal obligation to inform the agency of any change, many fail to comply with this obligation but the agency will investigate any change reported by the other party or a 3rd party.

  7. Are there any penalties for the PWC claiming CSA when she isnt entitled???? nope nothing happens to her you just carry on regardless but threaten the man with prison and taking driving lisence etc if he doesnt give a change in Circumstance, is there a reason for this?????

Just to add, a child is not a child when they turn 18, they are legally adults, they can drink, drive, smoke, and work to earn there own keep, this CSA shit that they keep collecting is another way for CSA to make more oney by leaving it sitting in an account to gain interest, even though the claim to be NOT FOR PROFIT,

  9. lisa:- Child Support Calculation Regulations 2012. Section 95,
    “The definition of a child should be the same as used by the Child benefit for those aged up to their 20th birthday”.
    The link to child benefit offers a simple test for the Commission.

  10. Does this also go for the fact that nowadays child benefit cant be claimed by families earning a certain amount??? surely to god if the PWC had a family income over 40k then it would be stopped then the CSA payments also stop, worth looking into

Do people actually know this though, if a family income from the PWC exedes the ceiling amount which doesnt entitle them to CB then why should they get CSA, it was just a point that to be honest nobody has ever raised before, if a NRP is struggling to make ends meet yet the PWC has an income that is huge its not fair the NRP should still pay,

  12. lisa:- The child benefit is not stopped, it is reclaimed through the tax system as it used to be when it was known as family allowance.
    They can choose not to claim or cease claiming if they wish.

  13. Even so does that also mean if they are not claiming it because there income is over the threshold they wouldt be entitled to CSA????

Maybe people need to know this fact now, i know of a few couples struggling to make ends meet and the wife/partner has got a huge income while they are struggling, maybe by spreading this news it might save a lot of NRP heartache and they might be able to afford to do thnigs with there kids instead of being skint,

If No child benefit no qualifying child, what procedures are in place for the CSA to check the alledged PWC is eligible to recieve payments, The CSA would be breaking the law to remove money at source from a person claimed using fraud, surely they MUST have a process to protect them from this? They as a collection agency would leave themselves wide open if they did not have due dilligence around their methods, or is this process outside of the law too? By just relying on the PWC to come clean it puts a burden on the NRP financially that proper procedures should prevent.
