CSA keeps adding arrears every year
My partner recently applied for a re-assessment of maintenance based on his end of year accounts ( april 2011 – april 2012), as a company director he draws dividends and these figures are submitted to the CSA every year, we have long since argued about including arrears as regular weekly wages as dividends drawn can fluctuate from year to year, even our MP argued this but…you guessed it, under some legislation/act, dividends can be calculated in to weekly earnings!!
Our problem is that when re-assessed every year underpayments are backdated as long as the CSA see fit thus resulting in arrears, and yet overpayments will only be backdated to the date of re-assessment request, in my partners case only 3 weeks when in fact he has been overpaying since last assessment ( 12-18 months) , what i want to know is can the CSA backdate overpayments for more then a year when they can backdate underpayments dating back some several months/years ?? we are in the process of appealing to the central appeals unit as well as have written to our MP…..am awaiting their responses with much anticipation & hope!

CSA are truly a law unto themselves and nothing whatsoever surprises me.
I do not understand why they are backdating anything at all. I had this argument with my partner’s arrears as far as we were concerned he had overpaid but they said no, once an assessment is in place that is it and that is what you have to pay. I thought once an Assessment in place that is how much you will pay, and then once re-assessed you are due that amount from the date the CSA have re-assessed you.
hello the csa , are taking the biscuit they was on the old system and since they change over they put people on this arrears thing . its never therre fault but you got to pay arrears well am fed up with the way they treat people . i hope they can take time out and check the system properly before contacting people saying they got arrears i been paying csa since as long as i can remember and wasnt in any arrears and now it seems i do so the csa must be doing something wrong . i hope the goverment scrap this system …..
