CSA is withholding my payments

After taking the CSA over 2 years to get it sorted, my son’s father has been making regular maintenance payments including the arrears he owed. For the last 2 months he has made payments of £180, and all I have received is £21 of this. I’ve phoned to ask why and all the CSA can tell me is that the rest of the money has been ‘allocated to the Secretary of State’. Knowing that the payments had been made, I was expecting and relying on receiving the money.

It seems the CSA will continue to take money from the absent parent and then refuse to pass it on to the parent with care, whilst also refusing an explanation of their actions. It seems outrageous. I have no confidence in the CSA at all anymore, and have been forced to hope that my childs father will send us fair payments directly from now on, as it’s now the CSA that can’t be trusted to pay up.

  1. Hayley the same thing has happened to me as a PWC. When I phoned they told me the same thing “Sec Of State”. My ex is currently paying to the CSA £485pds a month for 2 children plus arrears for 12 months (being £2500.00) of which I receive £135.63p p.c.m.

    After many questions and probing the CSA admitted their computer system gave no details except showed “Sectretary Of State” and that I had and would not have a case worker but it must be becouse I”m on “BENEFITS”. In my case “WROUNG ANSWER, try again” especially as I have financially supported the children for the last 8 years with an occasional pittence from the N.R.P. Then I demanded to speak to a Manager otherwise I would tell the NRP and advise them to stop payments until this was sorted. After all what was he paying for?

    Next day Manager calls same gumph don”t know ie must be benefits. Therefore I ask if I owe the Sec of State how much is the debt? Answer “over £6,500.00 pounds” L.O.L. “Wroung Answer. TRY AGAIN” cos I have letter from CSA saying I owe exact same amount according to them to the ex for an overpayment screw up they made dating back to 2003. Reply from them was well we pay ie “fund” in total the overpayment back to the NRP so now you owe the Sec State. LaLa . So anotherwords any Overpayments made by the NRP refunded back to them in a lump sum yet any arrears due a PWC can be paid off when ever……..Yawn.

    But seriously in your case you MUST find out how much they say your actual debt owed is (Demand if necessary to speak to a Manager and tell them you want it shown on your computer record). You want to know EXACTELY what its for ie Sec Of State is insufficient and put a detailed note in your diary of the conversation.

    Also if they say its cos of benefits check all your letters from CSA under the heading Change of Circumstance becouse it used to say “if you on benefits they will tell the employment office”(words to that effect) but now it says YOU must tell the employment office. I presume they mean receiving Child Support through the CSA although its not made clear. Good Luck

NRP's have been speaking up about this for ages… blimey! bout time the PWC caught on to what was happening and why NRP's have been reluctant to pay up… the CSA rip off our children, they abuse our childrens civil rights by denying our children support, they do not support our children… they are stealth taxing our children…FACT!

  3. just wondering really….but CSA threaten court action and prision to people who refuse to pay.
    so where do they stand regarding taking money from ex husbands that do pay, then fail to pass it on, with no other reason apart from “its gone clerical”?
    and after they have admitted “gross misconduct” in compensation letters, assured a case worker would be monitoring my case and this would not happen again…..only for it to repeat every 6 months?
    if i was taking someone elses money and not passing it on to the correct people, isnt that thieft? maybe deception, either way i would be arrested and in court before i had time to make feeble excuses.
    just because they are a government agency, does make them beyond the law, as im sure a few MP’s found out last year!
    something needs to be done and soon….

  4. I make payments for my son who is 16, he is about to become a dad, does this mean my payments will stop or continue, he is in full time education,and lives with his mother.
