CSA is making up excuses for why my previous payments don’t count

January 8, 2015

I have had nothing but trouble with the csa since day one demands and greed so 1n 2012 me and my ex had a chat and we decided to make a family based arrangement.

I kept to to it till September 2014 when my daughter turned 19 and moved out and now the money has stopped and now after two years ive just had a bill of nearly 3 grand she is saying shes had nothing.

I can prove shes had regular payments but the csa are coming up with all kinds of rubbish bank statements have to say csa on them did you have a signed letter from her.

Im now having to go through citizens advice to try and sort it out 3 weeks have gone still no phone call from the csa to discuss it no break down of payments they just came up with a figure and expect me to pay it.

The trouble here is proof is not always proof. by this I mean evidence is always open to interpretation. then there is the fact that the CSa dont investigate mothers claims only the fathers.

so do you have any evidence of this agreement?

if you dont then its a very hard road.

thinking out of the box a little you could at least threaten to sue the ex for breach of verbal contract. I recommend you google Brogden v Metropolitan Railways so you can see what I mean.

but your problem is still evidence

so as I am typing this the idea of entrapment comes to mind. perhaps invite your ex for a coffee and discreetly record the conversation re: an agreement then you will have evidence which can be submitted

sorry I cant be of more assistance. to those who are reading this while a verbal agreement is enforcable it is almost impossible to prove so get all things in writing and keep letters and send letters with a proof of posting so there is a paper traill.
