February 12, 2014

For the last 10 years my husband has been paying his ex money for his kids we are not aloud to see them much but if we do it’s when the mum has kicked one of the kids out and they come to live with us .. We do pay maintanence but in the last 10 years he has been in a couple of jobs witch has put us behind the CSa said we have to pay £70000 back to them we have payed £5000 back plus the ex they was taking £370 month off us witch left us do skint we could not Ford the family we have here .

It in the end put so much strain on us we split up … We have got back together again but it is happing again we have been paying them £60 for two they sayed to us pay £43 to the ex and the rest to the rest of the over payment witch we could just about manage … But no now the CSa want to give the ex a pay rise with are money and ask for 40% of r wages again now we are back can not pay are bills or live so it’s putting a strain on my marriage how can the CSa be a good thing

The CSA (or the new CMS, same beast new name) are not a good thing, unfortunately there is no fairness or morality or intelligence in the system. What little there is is lost by the bias that seems to exist in those operating the system. This can clearly be seen played out daily by the responses seen on a number of posts even on this site, it is such an emotionally charged question that it cannot be addressed with the pure logic built into the CSA/CMS process.

Sounds like you need some professional advice on how to play the system as your situation certainly sounds unfair and probably incorrect. Only piece of advice I can offer is do NOT listen to CSA advice on what is apparently correct, it is usually wrong, and when it turns out that way, it is down to you anyway, no refund and no way for them to actually correct the problem they caused.
