CSA forcing sale of house making child homeless

I am a single parent living in my mortgaged home with my 14yr old son. I have, from a different relationship, a 22yr old daughter who I’ve always supported financially directly to her. Last year, after a dubious phone call, I was informed that a case concerning the CSA and their alleged maintenance order, regarding my daughter, was being convened in Milton Keynes the next day. As I was unemployed at the time there was no way I could afford to travel to Milton Keynes to contest their allegations, as I live in Oxford. I did not receive any paper work concerning this case and the next correspondence I received was from Oxford County Court stating the CSA wished to apply a Charging Order on my home for the sum of £25,000 which is equal to the apparent maintenance order obtained without my presence at a Milton Keynes Court.

I attended Oxford Court and successfully obtained an adjournment while I contacted MK to have the case put aside. At the time I felt legal systems and solicitors untrustworthy and therefore sort help via the internet and found some help via www.tpuc.org a site that offers support in legal matters concerning Lawful Rebellion et al. After being put in touch and receiving some help from Deadbeatdads another site dedicated to people fighting the CSA I sent affidavits to the CSA and Milton Keynes declaring my beliefs and stating that my rights to a fair trial were ignored. I received a letter back stating my Affidavit had no legal standing, in this case, and was not the right process for applying for my case to be put aside, and also that I was out of time in order to get the case put aside.

Attending Oxford court again, the magistrate told me that I may well find remedy in the case but he was not legally able to avert the charging order or remove another magistrates Judgement. The Charging Order was applied but the magistrate assured me that it was not closed or final and could be lifted at a later date if I could successfully get my case put aside. The stressful process was already taking effect on my health and so I decided to shelve the case and get on with my life, concentrating on my son’s promising sport ability in Ice Hockey. He was selected to represent Team England U14s in a trip to Canada 2010 for a tournament there but due to a series of injuries had to pull out which was obviously devastating for the both of us and ruined Christmas as we were meant to fly out on Boxing Day etc.

Earlier this year I received a letter from solicitors working for the CSA stating their intention to apply to the courts for the forced sale of my family home and my children’s inheritance. The Government via their agents, the CSA, are wilfully intending to force my son and I onto the streets, rendering us homeless in an effort to reclaim money they claim I owe for maintenance of my Daughter who has never received a penny more than her legal entitlement of Benefit. This Act of Parliament will therefore cost the Government a lot more money than they wish to reclaim as I will be forced to apply for housing by my local council and this case will obviously add to the destruction of my family’s assets along with destroying my son’s life and expectations of English Law as he has just been permanently excluded from school as a result of his behaviour at school which is directly associated with the stress incurred by Government Legality regarding Child Support.

My daughter is also affected by these Acts though not as much as my son because of her age. My whole family is terrified of the outcome and I’m finding it increasingly hard to find any legal support to protect my property, home, health and family, and as an unemployed Carpenter/Builder my way of earning a living from developing my home as a potential property developer.

My family is a close knit one and have always supported each other when needed. Ironically after the birth of my daughter her mother’s father and my mother entered into a relationship, as they were both single, and eventually married effectively making my daughter’s mother my step-sister. My Family and I have always supported and cared for each other but it appears we can not stop the devastation and intended destruction of my family unit.
