CSA failed to represent me

My story started in 2003.

I applied to the csa for maintenance for my 3 kids and a calculation was made that ex huby should pay £63 per week from thereon, to this day in 2010, I have received about 6 payments of £12 ish.

Here is the problem,everytime the csa contact my ex, he repeatedly changes his circumstances, he either becomes out of work apparently, a student, cant find his bank statements,he has brought up every excuse in the book, mind you he has since bought a property and had an elaborate wedding, travelled to Nigeria while his kids are out of school shoes, he is self employed and does his own accounts, the csa never write to me with replies, they sent in their enforcement team and private investigator to tack his movements and his employers said he was working parttime and not full time which was just untrue.

Everytime i phone the csa, they say there has been an account breakdown, they are trying to sort out a payment schedule, this has gone on for so long at our expense. I am at the point of instructing a solicitor to either write me a letter of intention to sue the csa for failing to represent me or to sue him for failing to provide for his kids.Any advice would be greatly appreciated.

  1. the answer to this is give 50 percent access to the father then both of you can work full time and proivde for your kids

    dont waste time with csa they are very retard people who work there

    as for the csa will not go after him as he self employed the to much hard work for them

  2. Unfortunately Hannah you are not alone, Ive had 12 yrs as my ex is self employed and Lisa similar time frame too. Please join the facebook groups Child Support Agencies Failings and others, and you will get advice and support on there as there are so so many of us in similar situations to you. The CSA are meant to work for the children (ignore Martin above – he lives in an ideal world, – I live in the real one!) there is no charges or any motive behind the group (or others on facebook too) as they are for people like us who have suffered alone with our children due to the CSA not dealign with the self employed.

  3. Hi Hannah so sorry to hear about your circumstances. Mine are virtually the same. Keep a schedual of all contact:~ date when csa officially took on your case~ phones calls with names, dates and times and reasons they are giving for non paymnt~ copies of letters to/from csa~ copies of compaint e-mails/lettersThen put them all in date order and visit your local M.P they can be very helpful. Also, in the meantime go through the complaint procedures giving them 60 days for each stage an tell them that you have seen your M.P. This will all take time because your ex is "non-compliant" but you will have a very solid case for the ICE and M.P.Hope this is some sort of help. Good Luck.

  4. thanks for the advice, he has sum kind of vendetta where he thinks I want money off him so I can spend it on myself, hilarious guy eh??He actually owns his own cleaning company and has done since 2005, yet he does his own accounts obviously,How do ICE play their part then.

    you cant have all the money and the other parent nothave access how is that taking responabilty as for the real world is to be treat fairly not unfairly

    why should we pay 1 person you to bring up our children when 50 50 gives you both the chance

    Firstly I totaly understand Hannahs frustration as I am in the same position… 1 step forward 6 steps back, everytime you ring there’s another account breakdown being done (The CSA do more breakdowns than the RAC!) or a payment schedule being sorted…… I ask them why they are bothering when they know he won’t pay… I am told they have to do this in order for when the case goes to court ….. That in itself is a laugh as my case did go to court in July 2008 and a LO was granted for a debt of aprox £6,000…… Over 2 years later the debt has risen to about £9,000 and still NO money but loads more breakdowns and payment schedules…. As Martin pointed out the self employed are far too much hard work for the CSA…… They much prefer to target the employed, make up stupid amounts of arrears and then screw them for 40% of their salary and make their life’s a living hell ( I work with a guy that this is happening to)……
    Up until August 2007 my ex was employed and although HE CHOSE NOT to have contact with his daughter he paid every week… The problem was he never paid the full amount and although I was happy with what I was getting, someone else involved in the case was not and made a complaint. This resulted in him being awarded the good old DOE…. My share alone was to be an eye watering £90pw for 1 child!!!!
    So in December 2007, he quit his job, went self employed and has only made a handfull of payments since…… The real frustrating thing is, I would have never bothered chasing the arrears when he was paying and he probably would still be paying if it wasn’t for the unreasonable demands of the CSA…. In a nutshell the CSA makes everyone a loser…… I struggle to make ends meet (so I fight for money)… He probably gets constant hastle (so he digs his heels in even further) but the biggest losers of all are the children (the very ones that the agency was set up to protect)
