CSA doesn’t take into account living costs of NRP

I have just read an artical about what to do if you think your CSA payments are wrong… while reading it, I noted that it is estimated to cost an average of £775 each month to bring up a child (I believe this was written to make the NRP feel that things could be worse!) but the point that the author (along with the government and the CSA) seem to be forgetting is that the reason MOST fathers dispute the amount to be paid is because THEY CANNOT AFFORD IT!!!

A lot of NRP’s don’t even earn that!! Other NRP’s have only a 5th of that to live on each month after the CSA has been paid. Then the bills etc still have to be paid.

The BIGGEST ISSUE NRP’s have about CSA calculations is that they do not take into account the NRP’s ESSENTIAL living needs… rent/mortgage, gas, electricity, food, council tax… all this MUST be paid to allow them to survive!!!!!

I will guarantee that 99% of fathers would happily spend £775 each month on their children if they could afford it!!!

Why cant the government and the CSA CEO see this???? Most NRP’s are normal, loving parents who want the best for their kids too!!!

  1. Sally,

Unfortunately, I doubt there will never be a system in place that suits everybody…

We should not forget, there are also NRP’s on CS2 who are content with the way the calculation is made and other’s on old rules who’s liability, if calculated on current rules would be a lot less.

Prior to 03/03/03, old rules took into account a NRP’s living expenses and the NRP’s new partners (NRPP) ability contribute towards the family home (quite a few NRPP were unhappy about the finical info they were expected to provide) .
Under these rules, some NRP’s were assessed, despite having good incomes, with a nil liability. Others were/ and still are paying a damn site more than a NRP with the same amount of income, children etc on new rules. The latter are presently unable to migrate to new rules, unless they are involved in another case or the PWC closes the case for 13 full weeks and re applies under the present rules.

  2. Does that 775 include rent etc, cause I can tell you now it doesn’t cost me even that with two children!! Where have they got these calculations from, the Kardashians by any chance?

  3. @ Jay – i’m not sure where the calculations came from but if you look at the link you will see it’s obviously by someone who does not live in the real world!! I’ll bet someone (probably a family member of a minister of parliament lol lol) is paid 100k each year to sit and come up with these rediculous sums of money!!! lol lol

@ chall…. I have read a lot about CMEC but wondered if you could answer a question for me…

My partner went to the CSA because his ex demanded he pay her a lot more money each month because he had ‘additional income’ (ME)…. it transpired that he was paying her slightly more than the website recommended. She reduced the overnight stays so that she would get the maximum amount of money from him… he organised the payment etc and has never missed a payment since…although CSA were involved (cofirming the amount payable each month), the money has gone directly into her account each month….

My question is – is it only the people who pay via the CSA (i.e. those who pay the CSA each month instead of direct payments to their PWC) who will be issued with a letter asking if she is happy to continue using the CSA??

    Many thanks

    Sally

The decision of continuing with the CSA OR receiving direct payments from the NRP will be the PWC choice.

  5. Thank chall – a follow on question from your answer is, could my partner request payments to be made via CSA by application and if so will the amount agreed still have 30% deducted from the amount she recieves and add an additional 15% on to what my partner pays i.e. if he should pay £100 he will actually pay £115 but she will only recieve £70, the rest will go to CMEC for admin or whatever they call it??

The reason I ask this is that I know that when she recieves the letter from the CSA she will contact my partner to demand an unreasonable amount of money and threaten him that she will go through CSA (as she did when I moved in with him) and i’m sure she will come up with some twisted lies (about the amount he will have to pay etc if he uses the CSA) in hope that he will give in and pay her what she has asked for to save any hassles (which he almost did first time around)…. I’d just like to get my facts right before she contacts us….

    Thanks again for you help!

  6. Sally,

Either parent can make an application through the CSA. Either can also decide that payments should be collected by the CSA.
The PWC would have to agree to receive direct payments from their ex, as opposed to the CSA collecting such. Also a PWC can close a case early, a NRP can not.

Until CMEC fully comes into force, there is no charge to use the agency. Until the figures are finalised for the proposed fee’s to use the service, I really couldn’t say.

  7. Thanks again for all your advice.

I realise you are completely impartial to everyone and here to provide the best guidance and advice you can. However, I don’t want you to think that this is all about the money for me, this is about trying to stop his ex emotionally blackmailing us and harassing us by demanding money she feels she is entitled to.

My partner has never missed a payment to her, we buy the kids clothes, gifts, take them on holiday, we have tried to keep them out of the trouble between their parents and give them as much fun as we can when they come around…. it has taken us over a year to get here…..

I just dread all the trouble the mother will try to cause when the CSA changes over to CMEC and i’m trying to avoid it, or at least be prepared for it with some facts.

    Thanks again

    Sally
