CSA doesn’t listen to me at all

I was recently told that I would not be granted a variation to my CSA after paying £10,0000 for my ex partners credit card and £8500 of a loan which was in joint names. This money was being paid with the knowledge that it would be used as an adjustment value to the money I already pay. I was supposedly send a variation form which I never received and phoned the CSA constantly to get a new copy sent I had all the paper work which included schedule of payment for all the monies I paid and confirmation from Kim MacDonald that I was paying this. I am now in the process of suing Ms MacDonald for these monies paid as I now learn that the CSA have decided that I can now no longer use them as a variation due to the length of time and no further evidence of which I would have sent if I had been sent the variation for in the first place. I have a number of complaints against the CSA of which include items that should have been addressed.

I must stress that I have no problem supporting my child that I have never seen due to not knowing where he or his mother are or have any contact with. But what I do have a problem with is being victimized for working hard and being taken advantage of by a woman who is clearly using a flawed system to simply gain money to fund her more than lavish life style. My solicitor is forming a formal letter of complaint and I will be looking to sue the CSA. For your records and reply I will include what I intend to complain further about.

Failing to take into account a massive amount of money paid to Ms MacDonald for variation. as per your handbook states that you would take into account payments on a loan or taking on an ex partners debt before separation with the parent of care.

2) Failing to take in account that due to having to use a lawyer and private detective to track down my son and Ms MacDonald as the only way to see my son this would be counted as an expense to see my son! As per your statement of your hand book page 28. Of which has cost to a total of £7500.

3) Failing to fully investigate my claim that the CSA say they have no record of myself calling to say that i would be out of work as of the 20th Dec 2010 due to redundancy I phone numerous times to tell them that I may have employment but fell through till the 28th march 2011 which they have been made aware. subsequently charging me arrears totaling over £1000 from Christmas till the 14th feb when they say I informed them of my lack of employment.

4) Failing to take into account the lifestyle of Kim MacDonald that would more than suggest that she is hiding money and assets. And the fact she is now living with a partner.

5) The complete disregard to listen to anything I had to say and constantly repeat “I understand sir but there is nothing I can do to help you”

I have made every effort to comply with the CSA’s requests and have always paid whats due. It would be in the CSA’s and Kim Macdonald’s best interests to keep this from becoming a very expensive drawn out process I will be taking this further with my MP and raising the awareness of the CSA’s lack of compassion or moral grounding to the situation.
