CSA claim I should have told them of my change in circumstances – is this true?

I had a letter from the csa asking me to ring them regarding my maintence payment my youngest had just left school so i thought it was about that In fact it was because they said i owed them money as when my son had finished college the year before the payments should have changed. I told them that they did reassess it and there was no change.

Apparantly i should have been telling them of any changes so its my fault. I now owe my ex over £2,000 pound which i refuse point blank to pay because as far as im concerned its the csa fault as they didnt adjust the payments.

Can any one help me with this can you refuse to pay am i liable for this debt. Its laughable really as i went to them as my kids father didnt want to pay for the upbringing of his children and now im gonna be the one with a debt. They also told me that if he dosent want the debt repayed now he can change his mind at a later date thats like a bullet to my head.

  1. kay,

A PWC does have an obligation to inform the agency of a change of circumstances.

Did you contact the agency and inform them your son had left education?

  2. yes, it is true, you have a legal obligation to inform the CSA of any changes that may affect the maintenance you are eligible to claim from your ex.

When your son left education did you inform the child benefit department and CSA?

if you have claimed for your son when he no longer qualifies and have been overpaid then you may be required to repay this money, the CSA money overpaid will be reclaimed only if your ex wants it repaid to him,
