CSA chasing me after four years

October 21, 2011

I had an amount of £637 outstanding that was not arrears, it was a genuine dispute from a time when I was paying both CSA, and under the terms of the old fashioned maintenance, the total mortgage payment, 50% insurances and 50% repairs to the property where my ex still lived. Yes, I had to pay both!! Eventually, the CSA saw sense, and reduced the amount of CSA payment, but did not back-date it to the correct date. Hence the dispute.

I last heard from the CSA in 2009, who were chasing me for the £637. I told them about the dispute, and while I was on the phone, the agent told me not to worry, because he had just noticed a message on the case notes, that in 2007 my ex had told them that she did not want the arrears.

Now, 4 years later, I have just received a phone call fromn the CSA, informing me that she has changed her mind and does want to persue it. My problem is that for for 4 long years I have believed that this had all been “put to bed”, and consequently have destroyed all the documentation I had. I am fuming!!!! Can anyone give any assistance?

when a parent with care decides that they do not wish arrears collected the arrears are suspended, the parent with care can contact the CSA at any point and ask for the arrears to be reinstated and collected by the agency on his/her behalf and the agency have to contact the NRP and request payment.
