CSA allows my ex to commit fraud

My soon to be ex decided that she would claim csa in nov 2006, telling them we were no longer together.

I phoned the csa department up when i found this out and was told by them there is nothing i can do about this. So i have been paying for my kids for 4 years now, just under £8,000.

We are now getting divorced fro jan 2011.

So been in contact with the csa about her claim whitch in my eyes is fraud, as i have bank statments ultilaty bills joint bank account details ect that proves we were together all that time. But its like banging your head against a brickwall talking to them, all they are bothered about is that i owe them £2,000 for last year as i no longer work, not that she has comitted fraud.

I have sent all relivent information to the csa but i will not be holding my breath. It seems that women can get away with what ever they want to.

  1. When did you actually separate?
    You made a very big mistake by paying. When you were still living together were you paying the bills, rent or mortgage, food clothes etc?

    Write to the CSA, do not phone, detailing that you were living together and that you were paying all the bills, including providing for the children, and then detail the actual date that you separated.

    Did you move out, or did she?
    Where are the living children now and how much time are they with you?

    Then in the letter state that clearly the claim against you was false, as the children were living with you and that you were providing for them and that she should therefore have been paying maintenance to you.
    Does she work?

    Then demand that they do an assessment from the time that you actually separated and that all money taken prior to that date must be returned.
    Give them fourteen days to reply. If they don’t then escalate the matter as a complaint and copy in your MP.

  2. I have paid csa payments for my twin boys until they were 18 this month. One of them has been working for over 6 months the other dropped out of college around a year ago. When i rang the CSA to enquire when my payments stopped they replied they had been in touch with my ex partner and she had told them they were both still in education therefore i must keep paying!!!! I must prove otherwise so they are quite happy for someone one to claim benefits fraudulantly as long as i keep paying. I find this ludicrous how do i prove that one is working the inland revenue should have records for one of them working but they will not give me any information so just how do i prove she is lying?
