Can you arrange a private agreement when PWC refuses?
Not sure why anyone would want to avoid paying any form of maintenance for a child?
What I would like is the ability to agree and arrange my own payments with the PWC directly. But because the CSA in their infinite wisdom has calculated that I should pay 40% of my wages every month, the PWC (who still isn’t working after 10 years) refuses to arrange a maintenance payment through CM options, because she receives £650 a month from me.
So whilst I do not wish to avoid paying I wish to avoid the CSA and have the ability/power to arrange a fair monthly maintenance amount between me and the PWC.
Why am I refused what I see as a fundamental right in this free society?
The CSA doesn’t do any favours to PWC or NRPs, is a burden on tax payers and is discriminatory on an age basis. (Parents with Children born pre 2003 on an old outdated and more expensive set of maintenance calculations anyone?)
We are quite capable of arranging our own maintenance payments thankyou so please please please just sod off.
Can anyone give me some advice on how to arrange maintenance payments without the CSA despite the PWC reluctance to agree to a lesser rate of income?

You can’t!!! The simple answer is that! Funny thing is it is the NRP that has to pay but doesn’t have the FULL choice of options to pay.
Tough! I'm afraid that if EITHER of you involve the CSA, that's it
The PWC can end it but the NRP can't.
i think if your x partner writes in and explains to them that she doesnt want the csa involved then that should be it howeverif your x claims benefits they will continue to be involved because they want there money
If your ex claims benefits then they dont have to continue to be involved as the law changed. You can now claim state benefits and maintenance is not affected – for example, if you gave her £650 a month via the CSA she can keep all of it on top of her state benefits. However, only she can stop the claim.
jason is right.
This whole thing is outrageous and a bureaucratic mess. The CSA is protecting it’s own existence by forcing maintenance paying NRPs to pay through them to give the impression that they are actually worth the money the government pays them to deliver this ‘service’.
If the government wants to reduce the costs of running Quangos such as the CSA, they must give us the power to arrange our own payments without this dreadful organisation’s hideous tentacles interfering in our private lives.
I want to pay my mothers child maintenance, and I would be paying her maintenance regardless of the CSAs existence.
I swear that much of what the CSA does is actually illegal, but maintenance paying fathers don’t have enough money to pay legal fees to challenge it!!!
if you claim benefit your only allowed to keep a little for yourself as your benefit is the amount the law says you need to live on!you couldnt keep 650 a month and still claim benefit as you have other money coming in!
A PWC is entitled to keep ALL maintenance paid even if they are on income support, council tax benefit etc etc. The law changed in April either just gone or the one before.
12th April 2010. The system in this country is so fundamentally flawed that I would recommend that if you are on low income, you need to evaluate your position. If you are having trouble with the CSA and can, leave the country. If the PWC won't co-operate then you have a duty not to co-operate with the system. Co-operation merely encourages them to do it more! Make sure you record everything and cause them as much administration as possible, the more it costs, the more they are likely to do away with this agency and reform the legislation that created it!
YOU ARE ARE NOT ALLOWED ANY OTHER MONEY COMIN IN F YOUR ON BENEFIT!!my x and myself were happy to go along with the csa to cut out all our arguing.i recieved these payments whilst i worked but when i had to go onto benefits i was only allowed 10 pounds on top of my payment the rest was kept by the csa!!! luckily i am now back in work. The goverment will not pay council tax rent and money if you have ANY other money coming in!!!! you sign a decleration if you have to claim.
Alfred, your wrong, sorry. The law changed in April. My sister receives money via the CSA for her son and she is on benefits for the last month following her marriage break up. She receives full housing benefit, council tax benefit, income support, child tax credits and keeps all of the maintenance the father of her 1st son pays her. Its silly its changed – I think the PWC should only receive over and above what their benefits are – ie, if they receive £80 a week in benefits yet £100 a week in maintenance, they should only get £20 of the maintenance to pay the state back for paying for their children.
Sarah-Jayne you are right. my case is whilst Im paying taxes my money goes to a low life ex of my ex, who has children so she doesnt have to work so she not only gets all the benefit money and the csa money that I never got for my children from him – hows that fair?
This new ruling is stupid. It makes a mockery of why the CSA was put in place in the first place. It's also ridiculous that an NRP will be paying maintenance PLUS pays tax towards the benefit payments their ex partners receive..or in Karen's case, she is paying as well, and receiving NOWT!!!!
