Can my partner’s ex use my wage and tax credits in the calculation?

Ok, need advice on whether my partners ex can use my tax credits for my children and my wage to calculate the entitlement of csa from my partner. We are both full time students i have 3 children from a previous relationship, we claim no benefits however i do receive child benefit and child tax credits for my children although it is in a joint claim with my partner. I heard that she can claim from my tax credits! is this true?

  1. If your on CS2 amd your both students, its should work.out as nil assesment, because your not working, good luck

  2. we were both on ESA as joint claim when we were both not working, they took £5 a week as saw it as joint claim even though was my name (I am NRPP – non resident parent partner) and got paid to my bank a/c!!

    I tried to explain that how can they justify taking £5 a week, when we only got £113 a week to live on for 3 ppl (my son lives with us). They’re not interested!
    She, his ex (PWC) gets tax credits, child benefit etc, was on far more than us, and there is 3 in her household too!! How is that fair??

    The £5 a week wouldn’t have made a blind bit of difference to her – PWC, but she still pushed for it!! So we had to live on £108 a week for food, utility bills and a % of rent! We were left with £35 a week for food. I can tell you my son is a teenager and he could eat double that a week on his own!

The CSA cannot touch your esa or tax credits for a proper calculation, will be flat rate, £5 weekly, though if your students they cannot take anything, thats normally nil rate, if your having problems take your partner off your claim for tax credits, or keep putting in change of circumstances until they get it right, join our facebook group for more advice and info , http://www.facebook.com/#!/groups/204256966364149/

  4. well they did take from the esa directly as we were both not working, me as disabled long term ill health, my partner – NRP cos he was looking after me and had to give up work. as we were then classed as a joint esa claim, because he couldn’t get income support or job seekers as he lost his job cos I was so ill and he had to take time off so much for me. Not fair is it!! (I mean was it, this was up until beg March this yr)

  5. I did question it as the esa was in my name using my NINO!! But I was told there was nothing I could do about it!! He was getting carers allowance but they didn’t take it off that, although that % would have been dreadful as it would have been £5 flat rate taken from just £55 a week carer’s allowance! That’s a lot to take from just £55!
    Lisa I am not on FB neither is NRP as the evil bitch stirred a lot of shit and we couldn’t be doing with it. Can’t stand FB to be honest anyway so best off out of it lol.
