Can I claim money back from neglecting mother?

For the last 2 years my child has been on the at risk register as her mother was neglecting her. All the time I have been paying the CSA what is owed. When I changed my job it took the CSA 3 months to give me my new figure (with a 5k increase in pay I had a 400% increase in payments) this meant that I gained a debt as I was not paying enough for those 3 months. My daughter is now in my care but I am still paying the CSA all the back payments which is going into her pocket. The money that was paid never went on my daughter and it is now still going direct into her pocket and will do for the next 6 months. Can I get this money back? And preferably the money from the last few years so that I can spend it on my daughter now??? I get no help from the CSA as her mother is on benefits (though when I was unemployed I had to pay 40% of my benefit!!!)

  1. If you were paying anything more than a flat fiver a week while on benefits they have illegally stolen money from you! And now the child is living with you the payments to the mother should stop! Join child support agency ripoffs on Facebook and we can help you further

  2. Firstly, if you are now the parent with care, you need to apply for child benefit to be paid to you – then send this straight to the csa as proof you are the PWC. Child benefit is a big thing with the CSA – whoever is in receipt of it holds all the power.
    Then you need to set up a case with CSA against your ex for your daughter. She will still have to pay out of her benefits – unless she is living in a household with someone who is in receipt of income support or job seekers allowance then you will get nothing.

    Really dont think there is anything you can do about the mother still getting payments as if you had paid on time it is money she was legally entitled to and should have already had whilst being the PWC, its not her fault you paid late (or were forced through circumstance to be a late payer) so she will probably still be due it.
