Can I claim CSA from estranged husband for grandkids?

Me and my estranged husband have residency of our two grandchildren. Can I claim CSA from him as he refuses to pay anything towards their upkeep?

He says he has taken advice and as he is ‘non resident’ he doesnt have to pay.

  1. If he says he has taken advice and claims he is classed as the non resident, does this non resident legally mean non resident parent because if it does he should be contributing financially to your grandchildren.

    Does residency equal custody? I know if you have adopted a child that is not your own you are you have to pay maintenance. If you are fostering them do you get financial support from the local council? This may be a grey area regarding residency. You should be getting financial support from somewhere. More importantly at least your two grandchildren have you, it sounds like you are the only person they have got and although finances may be difficult as children are very expensive to raise you will get the reward of their love.   2. I’ve just googled it, residence is custody sorry. Your estranged husband has parental responsibility, I’m not sure if that means he has to pay anything or not. Phone up the child maintenance service for a definite answer. You could apply for maintenance of your grandchildren’s parents too by the looks of it too.
