If there is no case with the csa/cms the csa will NOT take the other child into account, no matter what they may have told you on the phone. They have LIED to me for years over this (thanks Mary Cockcroft and chums for your incompetence – calls recorded!), only found out in the last few months that this has cost me thousands, but of course it is never their fault, and as an ‘agency’ they never can be held responsible for their mistakes or held liable, money lost…).
Record all your calls with the CSA, for whatever good that will do you – if for no other reason than your sanity. Read Ofcom rules (on their website) regarding call recording, ignore the fact that csa tell you that you can’t, complete tosh, the law is clear, much good advice from Ofcom.
The only way I found to achieve this was to ask the ex who was not on csa to call the new csa (nominally named differently – cms / still run like crap) and open a case with them, payments for both cases are then automatically forced onto the cms system and recalculated taking into account all circumstances and children. You can use one of the standard calculators to get a rough idea of what the new cms system will cost you in total. Your ‘friendly ex can then opt to accept payments directly from you and close the case, they will still be taken into account for future calculations.
yes u need to send a copy of the PA to them or get the 2rd mum do to it or both do it as by law you can only pay so much so it have to be slit between them
use online work out thing see what that say when u put in paying 2 kids . then that get slit in half put that in the paper work as half want u pay then if u want to pay the rest up to 120 that u said to . but thatup to u if u have that type of money . when u start paying a 2rd mum the 1st will go down normal slit between the two
No as ones private and ones CSa
i’ve just been through this. I have a 14 year old who i’ve seen for 12 years before they stopped me seeing her then reported me to CSA. I have a 12 year old to another mum who we have a private arrangement for and see child as much as I want.
When the assessment was made they didn’t take into account the younger child and it looks like there is only one child. Unless it’s through a court order they don’t recognise a private arrangement, which is a disgrace as they are encouraging people to sort stuff themselves.
This meant that i would have to effectively pay 25% instead of 20% with the eldest mother getting 15%. So I rang up the other ex and told her to report me to CSA, which she didn’t want to do as she’d experienced 11 years of shit with them when I was with her. I then told her if she didn’t I’d stop her maintenance so she did but she gets paid direct, but the CSA now splits my 20% fairly between the two.
