Can an employer refuse an attachment to earning order?

Hiya,

Does anyone know if an employer can refuse an attachment to earning order? even his boss thinks its an excessive amount of money they are taking! We have had several phone calls to CSA and kept getting told different things! we were told we have protected earning of 888 but they left us with only 666, for a month! the rent alone is 510!

Then they said they will reduce the payments so arrears can be paid over 24 months, this we agreed to as it was just about manageable, then they changed it again saying they want arrears paid within 52 weeks so the rate has gone back up, to more than we can afford! we have asked twice to be send an income and expenditure form and they claimed we never asked! Do you think CAB could help us? They say they are going to investigate the claims that ex lied about the amount we had paid us this far but I dont hold out much hope of them doing anything they say they will!

    Since the CSA are breaching your protected earnings then yes they can, the accounts dept who do your wages can fax them asking them how they have arrived at the figures, they don’t have to give personal details but your payroll dept will know whats wrong or not, don’t let them take a penny unless its a reasonable amount

    Employers are intimidated by csa threat to prosecute if they do not comply. However
    if enough employers stood up for individuals like you, told the csa that the stress was affecting your performance at work and affecting company productivity then maybe it could change things.
    Like many things in life,if enough people stand up and fight,even if it means making sacrifices then the government would listen. Don’t forget we are all voters in a democracy and this coalition government needs all the support it can get!

    If its against human rights article 4 which reads slavery and forced labor why are not people fighting back, how come no high flying lawyer has stuck up for people in this position??? Or am I missing a trick and open up a little shop no win no fee like the pathetic accident claim lines that seem to have popped up on every street corner..

    If you think the protected earnings is incorrect you should establish the income details that the CSA hold for you – if your income is different to the amount the last assessment is based on you can ask for a re-assessment, you will need to provide evidence of your current income.

    If an employer does not apply a DEO to an employees wages they are committing a criminal offence and as such can face legal action.

    CSA are bullshit, ive ot been allowed to see my daughter for over a year, which is when this CSA crap started because I had lost my Job, up until that point I was payig circa 400 a month to cover School fees and bits, yet they dont take that into account. Im in sales so my basic after tax is 900.00, and they want just short of 400.00 to cover arrears… i would like to know who supplies them their crack!!
