Are the CSA allowed to take money from someone who can’t afford to live?
Hi,
This is for my sister who has recently split up from her husband. Their 14yr old son has stayed at home with his dad and he’s put a CSA claim in. She is on a low wage and is now having to pay for a privately rent flat and all the bills, but they have told her she is going to have to pay 15% of her wages irrelevant of the fact this won’t leave her with any money for food. Surely this isn’t allowed? They are potentially forcing her to go back to a loveless marriage, or she will lose her home.
Any advice would be great.

If you cannot pay then they may or may not force you to pay the set amount, or they may just ask you yo pay what you can, but if you don’t pay the full amount you will rack up arrears. They have discretion to spread arrears payments over a maximum of 2 years, but the arrears never go away.
If you believe their judgment to be unjust then you have to appeal their decision.

They don’t care if you cant afford to pay unfortunately. All they care about is taking your money n sod it if u end up on the streets. Tell your sister too that if she has any more children don’t tell the CSA or they will only take 15% of child tax credits too like they do with me and my husband to pay towards his son with his ex
sadly the csa scum don’t care about your personnel circumstances, this is a classic example of why the csa is so unfair. they will see you on the street and still come after you.I feel for you. I can only suggest she contacts her ex and try to come to a private arrangement and leave the csa out of the pic? I suspect he’s grinding an axe because you maybe the one who left him?
Tell him you cant pay that amount and will have to go on the dole if he persist and then he will get only £5 a week
Sadly what they are doing is allowed but like I said, they don’t give a shit.At the moment its 15% of your net income, they take no outgoings,rent,morgage,utility bills,work travel cost….nothing..its like you have no out goings only csa payments in their eyes.I understand its all changing next yr where claims will be closed and private arrangements are to be encouraged. future payments will worked out on gross income and come down to a starting of 12% subject to salary, but they intend to charge for this new system. nrp= 20% and pwc 7% I think but maybe some one can confirm

yes I have same trouble being screwed for one child while my four kids suffer good old csa not
