Always provided for my children yet I am being treated very badly

I have payed to my ex wife for yoears for my two sons, one is now 23, and the other is 19, paying £100 month for the youngest son but he started university in October, his mothers child benefit stopped on 3rd of September 2012, I informed the CSA in August,and have made many phone calls to them, and submitted evidence of the fact he is living independently away from home and is in reciept of student benefits ie loans, grants etc.

I am now at the end of my tether,with promises of follow up calls,I have made an official complaint recently and my case is been passed from one person to another, apparently to spread the work out? In the meantime I am paying £100 a month. This is a cut and dry case and is now nearly 5 months down the line, I live with my wife who is disabled, and 9 year old son. I am going to see my local MP today, as I had to do in the past when I was paying for my eldest son and should not of been.

What is so upsetting is I am being treat so badly when I have always paid for my children, seen them every weekend, and done as much as I could for them both.

Please publish this, why are these people allowed to do this, it is corrupt, and a disgrace to our country.

    My husband is in the same boat as you. His daughter turned 19 in September, we had a letter from the CSA stating that we no longer had to pay maintenance for her from 5/09/2012. My husband has always had the CSA money taken out DEO and the CSA, even though they have stated we no longer have to pay have suddenly decided that we owe them £484.00 to which we knew nothing about and for five months and counting the CSA are still taking money from my husband’s wages.
    What gets me about the CSA is that the money that is given to my husband’s ex includes my child tax credit for our four children and not only that the child tax credit includes disability and severe disability and she is getting 15% of that but I cant understand why they are still taking deductions of earnings when the CSA have told us that this was finished with back in September 2012. £217.90 has come out each month since September and that more than covers the arrears that “appeared over night” and with some money that should be returned to us. The CSA dont seem to want to close this case and when you do phone nobody seems to know what to do. We have just gone to our local MP about getting this stopped as well. They seem to rob the people that are easiet to catch. I have had a case with them since 2000 and they cant trace my ex and dont seem to do anything about it.!!!!!!!!!! as they cant just slap a DEO on to him, as he works cash in hand and the CSA have not bothered looking for him, despite having a legal document with his address on it back in 2004.

    I have had 13 years of ‘hell’ with this lot, and can empathise with your situations. I can only say that in all those years, that i have experienced repeated incompetence and almost wilful maladministration, that has caused me huge stress and profound embarassment. not my worrds, the words of my M.P.

    I have one left in the system, who will be 19 in a few months. The CSA seem to think that I am going to continue paying until 20, as they have ‘sneaked’ in legislation, without consultation. I will be seeking legal advice on this., as they are never satisfied and always want more from me.

    Like you, I don’t think that the CSA want to let go, and do not appear to understand that I have paid more than my dues in divorce and maintenance. It’s as if I have become a certain source of money for them, so they repeatedly target me. They just don’t want to let go, and sneak in laws to make those trapped in the system to pay even more, in order that their statistics on child poverty are made to look reasonable, when there are people who have never paid!

    The system has become a shambolic form of sadistic punishment, so if you are a sitting duck/easy target, they just keep coming back for more, as it’s too hard to deal with the ones who have never paid, or others who dodge the system.

    At some stage in the near future, I will be looking for restorative justice on the basis of being treated worse than a criminal by what is a not fit for purpose complete shambles of a government agency, that has sought to serve itself rather than either the children OR the PWC and NRP. That repeatedly targets those who do pay and does nothing about those who don’t pay or who have never paid.

    Good luck to all, and if the floodgates ever open for you to obtain justice against this lot, make sure that you give the same level of respect and empathy that the CSA have give you…….absolutely none! Take them to the cleaners!

    Sorry to hear about your situation. Do you have your data prints? They might give you a better idea of whats going on.

    Here is some general advice –

    ‘This isnt the csa its an open forum so don’t give names/details etc especially of children. (your own name can be used to identify the kids, and your case)

    Don’t deal with the csa by phone, everything in writing, sent recorded, keep the receipts.

    Copy your MP into everything and try and get them involved as your advocate.

    Make a formal complaint about any decision you are unhappy with from the outset as time limits are involved. Always go for an appeal tribunal asap following the internal process.

    Get a copy of your Data Protection prints from the outset so you know what you are dealing with, again follow the correct procedure in wording your request to get ALL information, send it to the right department, send the correct fee.

    Don’t be afraid to complain about any csa staff, or their superiors if you feel you have just cause.

    Remember the process, internal complaint, ‘independent’ case examiner (the csa protection department), appeals tribunal, parliamentary and health service ombudsman through your mp for maladministration.’

    You may pick up some useful info.

    Finally a specialist csa solicitor may be worth talking to but can be expensive and usually end up putting you in touch with a specialist barrister. Still worth an initial interview though but to reduce costs you can use a ‘direct access’ barrister (find through internet) and save on solicitor costs.
