Abusive ex claiming CSA while she pays nothing to me
I have been paying for my 4 children since 1998, from 2000 my ex wife has abused mentally and physically my children. 6 years ago the social services snatched my 12 year old daughter and put her into my custody, throughout this all I have paid over £30000 of court and solicitors fees to try and secure the safety of my children including having to fight a court battle to keep my daughter. My ex spouse did not pay any CSA towards her upkeep, while I continued for my other children. At 18 my son was kicked out her home as I no longer paid CSA towards him and he was not financially viable in the benefits system. She kept my oldest daughter as she was fraudently claiming carers benefit by reducing her to an emotional wreck.
Two days ago, I found that my ex-wife has claimed to social services during a neglect case against her that I am not the biological father of our youngest child. After speaking to CSA, they absolve themselves of any responsibility even though they have allowed this women to enter a fraudulent claim for CSA support for all these years.
They advice I take a paternity suit and if it is proven that I am the father, I will have to pay them from now until the results are through. If I am not in fact the father it is not their problem and they will take no action against this women. I am now looking at more court cases to which I have to fund, she will claim legal aid once again, for a evil child abusing women who has played the system and never had to work for anything. She is also about to recieve a large sum of money from my forces terminal grant for a divorce settlement based on adultery even though she has now admitted to commiting the act first and supposedly birthing a child with another man and misleading everyone that my son was mine.
All these years I have had to pay CSA otherwise they would have removed it from my wages directly and refuse to remove any outstanding debt from my account (accured when they sent the initial paper work to the wrong country and back dated 4 months of payments ) in leiu of the ex not paying support for our daughter in my care.

Stephen,
How old is the youngest child that you are still paying CSA for?
If evidence has come to light that cast sufficient doubts on parentage of a child, a NRP can dispute such after a calculation has been made.
The agency may agree to arrange a DNA, provide them with the evidence and request they refer you to cellmark for a post maintenance calculation DNA test , there would be a discounted fee involved, which you would be refunded if the child is not yours.
OR
If need need to apply to the court to ascertain such, you can download form c100 from HMRC website to ascertain parentage. It costs approx £175 and the court will organise a date for the case. They may rule that a DNA test is necessary (this will cost extra).
If you are proven NOT to be the father, you may not get all the money back you have paid prior to the dispute, as you didn’t question parentage initially and the CSA acted on the best info which they believed true and acted within the legislation.
Let us know how you get on.
