20 years of lies and cheating thanks to the CSA

We have had problems with the CSA for 20 years. My husband’s ex wife lied, cheated but no one listened to my husband. The children are now aged 33 and 29 respectively.

The CSA made some ridiculous assessment based on no evidence, they have never asked for bank statements proof of earnings etc. They wanted my husband to pay until they were 19 but both of them left school at 16 to work. We have always paid a monthly sum to what we can afford but they say it is not enough. We have told them on numerous occasions but they don’t listen.

They started proceedings against us to force the sale of our house and a court case was set for May this year. There were lots of mistakes on the court papers, they spelt my husbands name wrong and they said we had no dependents living at the house but we have a child in full time education. However my husband had a massive heart attack and died on 10th April. He had no preexisting conditions nor was he ill. The stress of all this no doubt contributed to this. Believe it or not they tried to adjourn the court hearing for 3 months but the judge threw it out.

We still have a charging order on the house, which has automatically transferred to me but I need to know how to get the charging order off. I have contacted my MP to help.

  1. Carcon,

I’m sorry to hear that your husband has passed away.

Did you take any advice on this matter prior to and/or during court proceedings OR apply for your husbands Data Protection file from the CSA?

If the liability in place was based on a penalty assessment or an Interim Maintenance Assessment and actual information could have later been provided to convert such to a proper assessment, this may have reduced the arrears amount.

I’m afraid you won’t able to ignore the debt, but it’s extremely difficult to give appropriate advice without seeing the all the information on the case.

  2. I am sorry to read about your husband passing away.

Money is the root of all evil and like you both my partner and I had years of hell with the CSA and his greedy ex wife.

We lost our lovely home and the week after he paid the so called debt they came after us for more.

My partners health got bad and he started having panic attacks. I decided enough was enough that his health was more important and we moved from the UK.

    We now live in peace.

There must be some justice out there for you as your situation is horrible. We got a Solicitor involved and it cost over £10,000 to fight them and we lost but I am sure your case is different.

Hang on in there and get as much advice as you can and fight to get the order off your house.

  3. I am sorry too that your husband has passed away, and seeing as his children are grown adults I can’t understand why they are still chasing you?!!

Reading this fills me with fear though as my husband has gone from being fit and healthy to having high blood pressure and this I am sure is down to the problems caused by his nasty, greedy ex and the CSA. I too suffer from panic attacks because of it.

My husband had always paid her direct but she insisted that the CSA get involved and they caused my husband to get in arrears by not taking any direct debit payments! She has stopped the children coming over as often as they used to so now is claiming more money because they aren’t here as often. I’m not working but am seeking another job but in the meantime it is causing us financial problems.

To top it all, despite it being their cock-up they are threatening to stop the money out of my husbands wages, a DEO, even though he isn’t and never has been non-compliant! He paid her direct for about 8 years, ever since she had an affair and they separated.

Her 2nd husband has a daughter that he never sees because she can’t stand her step-mum and she (my husband’s ex) tries to stop him from paying his maintenance payments!

  4. If I could make a wish come true it would be that everyone on this website printed off ALL of the heartbreaking stories and posted them to Ian Duncan Smith and David Cameron….. I realise this is unrealistic as it would cost a fortune but it really does break my heart and anger me that the government is actively promoting this system KNOWING that innocent people are being mistreated…. money before morals…. Britain in a nutshell!!!

  5. They treat decent. honest hard working people like scum and interefere in their private lives, as if they own you………..and they later ask for your help in census and elections!

Give these self ingratiating cretin politicians and civil servants two fingers when they ask for your help!

  6. The CSA are the lowest of the low. I really hope that the day will come when this organisation and the politicians involved with them get their comeuppance for the inhumane suffering they have inflicted upon so many innocent people! They are not fit to be part of society.
