I can’t afford the extra £460 a month she’s asking for
My wife and I have separated – she says that she is moving out with the kids and wont pay another penny towards our marital commitments incurred before we separated – she says that I will have to give her an additional £460 a month for child maintenance – bottom line I cant afford to pay maintenance if I have to pay her share as well.
Can you pleaae advise if she can do this as I will end up defaulting on our house because its not selling.

call up a lawyer they tell u want best to do , if she still living with u at mo i would kick her out keep the kids with u . their is no lawyer saying the kids have to go with her
The Court will award her thr kids and solicitors will advise the mother n kids stay in house as courts also award her the house with regsrds to that maintinance demand it appears she has already contacted csa told them ur wage n details and that is what the figure is so unfortunate but fact welcome to the world of being a NRP
Contact all your lenders and re negotiate what you pay if they won’t just declare yourself bankrupt. Sounds daunting but it really isn’t + will enable you to start a fresh. Worked for me + you will find most people who do it don’t regret it.
You will find debts that you have to pay such as debts incurred through marriage can be taken into account through variation, this has to be asked for and it will give a reduction on what you have to pay to CSA on what your joint debt outgoings are, the variation form is quite daunting but make sure you keep a copy of this form and send it via recorded delivery with photo copy evidence to back up your claim always keep copies the CSA are notorious for losing things
Sorry to be blunt but your biggest problem is that your a father. You have no rights, and your children will lose out as a result. Welcome to the world of money grabbing, vindictive, parental alienating mothers.
Put it down to experience and start again! CSA won’t help you with regards to joint debts! Neither will any court if she is on benefits or you earn more money than her! Sorry, that’s the way it is!
