Partner’s ex going to CSA saying we haven’t paid

My partner and i have been together for 4 years, we have a child together 3years ago. My partner has always paid for the last 8 years he hasnt been with his ex. Since i have been with my partner he has paid in cash Child Maintenence every week for his child of 10yrs old to his ex which was fine for her, Up until 10 months ago when we was struggling to even buy food for ourselves and our child and both lost our jobs. We had spoken to my partners ex and she said that not to worry about CM and to concentrate on our own family and keeping our house.

My partner works early hours to around 6pm 5 days a week and works weekends too till early hours of morning, so having his child over every weekend is a bit impossible and his child is at that age where she doesnt want to spend time with dad every weekend.

The ex is now annoyed because she hasnt got enough money (to get drunk with) so is now threatening us with going to CSA and saying that the father hasnt made any payments for the last 8 years……. can she does this?

We dont know what to do, we are on the brink or losing the house as well as each other.

    Hi Danielle,

    The CSA are involved from the first contact, either by phone OR in writing to the non resident parent.
    Was their past agreement private OR did it involve the agency?

    If your other half has an income and one qualifying child, then under current child support legislation he should pay a percentage of his nett income (this also includes any child tax credits + working tax credits if he is the main earner).
    A reduction would also be applied as he has a child living in his household.

    Dont worry about the ex’s ill informed threats.

    Any liability via the CSA only accrues from when the CSA first make contact with him. They have no powers to collect any CM that may or may not have been due or agreed with the ex before that.

    Ok thanks guys.
    So even if his ex went to the CSA she wont be able to get the CM for the last 8years? (even though we have paid her) she will only be able to collect the money from the first time she contacts CSA?

    No, not from when she contacts the CSA, only from when the CSA contacts the father.
