My kids never see a penny of what I pay the CSA

A few years ago i was working for a company and paid the csa about £108 per week for my three children, although the work involved was often seasonal so my earnings during winter months were quite low, when i was of sick i still had to find the £108 and started to accumulate a debt of about £1800 from this then after several years i left my job through getting a lot of back pain as the job was very physically demanding.

Now for 2 years i was unemployed but the csa kept on adding £108 per week to the bill which now stands at over £10,000 pounds & due to fact they say i did not inform them that i was not working that’s my problem even though im sure i called them after leaving, the £108 per week was taken out through attachment of earnings order which they now are in the process of applying for a new one to pay this bill.

I love my kids have them stay with me from time to time and visit them buy them presents and things, but the worst part for me is they have never seen a penny of the money i have paid and are not going to see any of this money either where is justice and common sense?

    Stephen:- Always keep the CSA informed of your up to date circumstances.
    Follow up any telephone call in writing preferably by recorded delivery so that you have proof of contact.
    Are your children adequately clothed,fed and housed?
    Because that what your money should be used for.

    Yes they are Housed by there mum and clothed by both of us to which the csa have contributed nothing as she has had no payments from them ever.

    If when money was taken from your earnings the PWC was on a benefit (not child benefit) then she would have received £10 per week along with her benefit payments and the rest will have gone to the secretary of state.
    This was discontinued on old rules cases in October 2008 when all monies became due to the PWC.
    If you have not paid the CSA since this time and not informed them you were off sick or unemployed then the case would keep on charging at the rate you described and the arrears would be due to the PWC.
    Ask her to telephone the CSA and say all arrears due to her have been paid directly and she does not want arrears collected.
    Make sure you request the CSA complete a reassessment for your new circumstances.

    If your file shows that you did indeed contact the agency to advise of change and they were notified and have not acted on such, then they could still carry out the change.

    It may be worth applying for your Data Protection File, with all not pad sections dated and a complete account breakdown, there is a £10 fee for such, but once in receipt, you should receive all the info the agency hold on you – Including if the change was noted and a chance to see if any mistakes have been made.
