Ex faked DNS test by switching with member of his family

I started off my claim in December 2011, i have had troubles with my babies father from day one of my pregnancy. Anyway he has tried to stop making me go through csa, which i did….he then wanted a dna test…which i was absolutely fine with as i had nothing to hide. Then the csa rang me saying the dna testing company (cellmark) have found theat the results show the person who they tested is related to my son, but not his father. so clearly my babies father has sent in one of his members of family, which is totally fraud. I then appealed against results as that was the next step, and i got interviewed.

The photo he gave me of the person who took dna test wasn’t even my babies father, and he got his details wrong, which is sufficent evidence. he then sent my report off to csa and their compliance team which has said to be investigated. i ring them for any information, and they say it could take months. they wont tell me anything more, which leaves me with a negative result and no payments what so ever.

I will not wait months and months, to years for this to be investigated… what should i do?

    If the above is correct, there is every chance your ex may be prosecuted.

    Is your ex named on your baby’s birth certificate?

    No, he’s not on the birth certificate, i havent’t seen him since January 2011.
    he kept ringing me asking me to not go through with the dna test, but now i realise the only reason he was trying to stop me , was because he knew he tried to cheat the whole system. I just want it all sorted, its crazy what he’s done. I just haven’t got a clue how they work their investigations, as im sure this isn’t an everyday occurance.

    Jay,

    If your ex refuses to do a valid DNA test the CSA can presume parentage.

    In which case the agency could impose a default maintenance decision if they do not have enough info to make a proper calculation.

    You should try and contact the agency (some staff are more helpful than other’s) and find out if they are going to assume parentage.

    But in this situation, csa think he has taken a dna test, but obviously i know it wasn’t him who took it because of the negative results, when they told me the results are showing it’s a close relative of my son’s but not his dad, (they asked me if i had been with any of his male family members) so fromt hen i knew he used one of his family members to take the test for him. csa now have to investigate it all to conclude the case. It’s just frustrating because i rang up to see if i could be updated with any information. And my case worker just said unfortunately they won’t hear anything until the criminalcompliance team have finished investigating it all, she said it could take months. I’m just waiting around now for the criminal compliance team to sort it out.

    Jay,

    You have already stated, you have had an interview due to the DNA results showing ‘ the person who they tested is related to my son, but not his father’ and you did not recognised the picture of the person taking the test as the alleged father.
    If the CSA have passed the case on to criminal compliance, they are taking the matter seriously.

    There’s a number of things the CSA may do, I obviously can not state what they will do, they may feel they have enough evidence to presume parentage regardless, OR offer a further DNA test to your ex, if he refuses they may then presume parentage, OR decide to prosecute for fraud based on the evidence they have already obtained, OR depending on the evidence available they may decide that he is not the father, etc.

    It is frustrating not knowing what’s going on, but I’m afraid you will be unable to speed the process up. If your ex is your child’s father and criminal compliance is getting a case together, the last thing you need are mistakes being made by them due to rushing things through.

    Did your ex have the DNA test carried out at his own Doctor’s?

    No he didn’t go to his own Doctors, he went to one out of town..

    I understand they need to investigate and make sure they get the right result.

    I was told my ex was not the father and waiting for interview and told by csa that it must be my ex from 3 months before, even though I was only 4 weeks when found out so how does that work.
