CSA admits mistake but still proceeds with case against me

October 7, 2010

The CSA say I owe them £19,800, I dont. I paid maintenance every month to my ex wife, via direct debit. She wanted the house so after two yrs I agreed to her suggestion that if I signed it over she would receive no more maintenance payments. (At this time it was suggested the boy was not mine, dna later, at my request, proved he was)The house was worth £85-100,000 in 1994. We had a mortgage of £8,000 on it. This was done via Solicitors.

Five years later the CSA came knocking, I had heard nothing from them until that day. They demanded money owing and I started to defend myself, no solicitor would offer help and certainly no legal aid could be found. I have never paid them a penny as I wanted my day in court.

In 2002 I was in Swansea County Court and the then Head of CSA in Swansea, stated to me outside the court, that “We should not be prosecuting this case Mr Cronin“, I received a liability order for the full amount.

In 2005 I was again in Swansea County Court and was found guilty of culpable neglect in not paying the Liability order, I received a 43 day prison sentence (suspended) on provision I met the £430 monthly payments. (The solicitor for the CSA had to jump to catch me as I almost fainted) I still refused to make any payments.

I have not heard anything from the CSA until today when all the funds from my bank account were taken, this includes rent due tomorrow and my staff wages for next week, (one of which is my daughter) I now have to ensure that all business I do is cash payments. I would like to know if anyone has a case similar to mine and also can the CSA take funds out of a new BUSINESS account I am setting up?

Plus unless your ex agrees that money you have paid was for maintenance then they won't take it into account !
