Why have they left it so long to contact me about how much I owe?

Right I’m basically the same as a a dad who is paying csa.
I’m a woman with 2 children who live with there dad we divorced a few years ago after 10 years of marriage due to me not being able to put up with him not working and not acting like a proper husband it all got to much.
Basically I agreed with him that the kids stayed withhim due to the fact I couldn’t afford a solicitor, he got legal aid where because I worked I had to pay and couldn’t afford it. Anyway cut a long story short. I have a new baby with a new partner I’m currently on smp for the next 6 months I haven’t made a payment to csa because they cannot deduct money out of maternity pay because its not classed as earnings. So my pay is protected (This also says this in black and white in there booklet) anyway got a phone call from them last night and I’m now nearly £600 in arrears. I explained that it does not explain in there book that I have to pay another way which they apologised
I also asked why they have left it this long to contact me about this which they can’t answer they even told my payroll at work they can’t deduct payments. So now anyway I’m on £530 statuatory maternity pay a month and there telling me they want £94 a month I explained that would be a lot due to a new baby here now plus rent and the reply was oh you have a baby in the house, how thick they were informed by me and my employer back at the start of january I was on maternity leave and can’t take any money as I’m on maternity they are so pathetic, they never read the computer information, if I have to phone them they go throughthe security questions then ask when I received my last payment….. read the bloody computer I MAKE THE PAYMENTS to the deadbeat dad who gets over £1500 a month in benefits….. sorry to rant and if it don’t make sense, I’m just annoyed and can’t really speak to anyone because a woman paying csa is not heard of!! I
Am not sure what you mean by “Basically I agreed with him that the kids stayed with him due to the fact I couldn’t afford a solicitor, he got legal aid where because I worked I had to pay and couldn’t afford it.” your financial status does not play any part in who has custody of children during separation…. regardless, you must provide for your children, am assuming that you had planned your new baby… there is no reason not to carry on looking after the older two you already have just as you will with this one.
my question again is the government so fuckin stupid that they don’t realise that people go on the dole to avoid paying and the ones who work get screwed for it! time we all stood together and got this law changed! who’s up for it?

The post is regarding the CSA failing to inform the NRP, A quite common theme with the CSA, then on discovering this they explain the need to reclaim this money/arrears caused by them at a rate that will place the NRP in debt due to their budgets which have not catered for CSA error. They have no regard for their part in the arrears or what debt will arise as a result of paying the increased unplanned un budgeted for arrears. Hence the problem if the CSA was fair and could count or check information before acting then these cases would not happen. However they do, legal aid for NRP is not allowed, Intersting one that, So I agree with the action taken by the original poster, The CSA force your hand and make error on error that The NRP has to pay for. Would you be happy footing the bill for errors someone else has made. Live the life as a NRP under the CSA following their errors then judge. She is not looking to avoid payment just understand why they had got it wrong information wise.
Suggest getting your data file £10 this will show all errors on your case, Complain to CSA and ICE, Maladministration has caused the arrears due to misinformation you have relied on, The CSA have a case to answer, So ignore Mel as she has ignored the facts and assumed, wonder who she could work for with an attitude like that?

Financial status does have a affect on who has the children as if it didn’t the children would be with me. Basically my ex partner drugged me up and tried making me look like a unstable parent, but what he really wanted was me out the picture and MY PROPERTY and MY CHILDREN which he got because as I said although I was working I was not entitled to legal aid but could not afford a solicitors bill of around £5000which it would of costed me and that’s from a solicitors own mouth. So my ex husband is living with my kids in my house which is worth £200,000 and I got sod all out of it………. but that’s not the point in my post was about arrears which as I have also stated I’m on maternity leave and they haven’t contacted me until now about this………. people make me laugh, they mouth on but never know the NRP story or why it happened……… note if I had the £5000 my children would be with me not my ex……. I’m not getting out of paying csa at all because it makes me proud to know that the children are getting my hard earned money andnot getting everything off the government…..
i said it many times, they dont care about your kids…… they only want your money off you.. they should be closed down and the mp.s should be looking into closing the CSA down as this is making living hell for us…. they taking £364 a month off me for the kids i cant c, they told my ex that if she stops me from having them she can get more money off me…they should never get CSA if they are on benefits.. this country if fecked up big time… if they care about kids then setup something for the fathers to c they kids in the first place…
Andrew exactly, I have to pay more because my ex husband will only let me see the children once a month, if he said every 2 weeks he would get less money and he knows that.
I’ve given up fighting with him. We split 4 years ago now and the subject is still sore. I could go on till I’m blue in the face about everything but what’s the point now. Andthank you stuart I will look in to that
I was in almost the same boat. My ex wife has my daughter, and I’ve had no end of trouble with the CSA. My new partner moved in with me, and I took full financial responsibility for her 8-year-old daughter. I told the CSA and they forgot – ending up taking 9 months. Then, because I have arrears (disputed, they have me down as self-employed earning £35k based on a website I put up, as advised by jobseekers, looking for work), they are taking the deduction and adding it to the arrears payments, so I’m no better off!
But my wife recently gave birth to our son, and I took 2 weeks paternity. I couldn’t see anything about this on the CSA website, and as I would have earned less than the amount to make a payment, I assumed they’d add it to my arrears. Wrong, instead they’ve asked my employer to make it up, which means for the last three months I have earned threshold pay, not enough to cover cost of rent, council tax, gas, electricity, water etc…
My wife doesn’t work, and when I told the CSA this, their response (the second time, the first they said they would add it to my arrears and tell my employer, then when they didn’t contact them, I called again to be told it couldn’t be done) was to tell me to go t the CAB, fill in financial hardship forms, and submit them, which they would then look at and investigate, which could take three months.
By that time my money would have been back to normal – but even if not, in three months without being able to pay rent or a service, something would surely have to give? They simply don’t care.
Charlotte – if you informed the agency that you were going on maternity pay there should have been a re-assessment – has this been done? Further to this, did you inform the CSA when the new baby was born?
If the first re-assessment has not been done you need to push for this to be done, the second re-assessment will be in respect of your new baby. If you informed the agency ahead of your mat pay starting the re-assessment will be effective from when your mat pay started, the second change (new baby) will be effective back to when the baby was born. If you notified the agency after your income dropped to mat pay that assessment will be back to when the agency were notified, the 2nd assessment will still be back to when the new baby was born.
Alice the csa were informed in december 2012 with a letter from my employer that I was going on maternity leave in january, I also had to send my wage slip with my 1st maternity payment to prove this.
My csa payments come direct out of my wages and the csa have been in contact with my employer. But because of protected pay the payments stopped and the csa even told my employer they couldn’t take any money but failed to contact me on the matter leading to arrears.
I went by there book (on how to pay csa) it says in black and white what is not classed as earnings and maternity pay is one of them so to me with them not taking money and me not being contacted I thought it would be put on hold till I went back to work.
Anyway I’ve spoke to them they want near enough £100 a month, so that leaves me with £400 to survive on witha baby, and mortgage and bills to pay, they only took £8 off a month for me having another child. I can see me selling the house and going to rent, I did explainthis to them but as they said bills don’t come in to it.
Oh had a nice answer machine message, if I don’t contact the csa by 8pm today I was threatened with legal action from tomorrow. Are they allowed to threaten you in a supposedly private and confidential answer machine message?
Ask for a hardship form.the only bills they take into account are rent,mortgage gas,elec and water. They not interested in any other type of outgoing not Evan poll tax . I’ve just sent for 1. Put a complaint in to the csa Chester po box 31 ch708dn. I’ve put a complaint in over the phone and they got back to me the next day.my payment went from£140 to £270.they added arrears onto it when all c.o.s was reported and took them 2yrs to sort out. The ex called them last month and they got that figure within 2weeks. She now just booked a holiday and I’ve had to cancel my sons bday party.its the same with sick pay they reduce your payment and as soon as your back in work they hit you with a new payment which includes arrears from when your off sick. Default letters on your mortgage or notice of possession on your rent can be taken into account as hardship.goodluck
They really are a disgusting bunch of shits the CSA, legislation my arse it is all down to incompetent staff not dealing with the issues when they are reported then expecting all to jump when they want something. The ivory tower is crumbling amid the fraud and incompetence and the reprucussions should see some smarmy csa bosses banged up for their dodgy underhand dealings. If the staff acted as they should then it may work but due to the lies and manipulative tactics and not all parents being as stupid as would like us to be, the chinks are starting to appear in this gestapo like quango. Took Hillsboro victims 27 years to get some justice, CSA will be a bit quicker now the victims are starting to cotton on to the illegal goings on.
