Where does the CSA get its figures from?

The CSA are an absolute joke & that’s putting it mildly. They are chasing my husband for over £7000 arrears & we don’t know where they get their figures.

My husband has had no contact with his son since 2001 as she being his mother stopped all contact when our first son was born, but she still expected us to pay for him, personally I think if the mother decides she doesn’t want the son to have contact with their father then you should not have to pay!!!

The CSA have now threatened my husband about taking his driving license off him until the debt is paid, if they do this then my husband will be out of a job & we won’t have any money & our family will be put into financial hardship, we have 2 young sons to support, is this the CSA’s way of punishment??

Well you should be do proud of yourselves then eh destroying families every single day somewhere in the country :@ my husband has made an offer to suit our budget to repay arrears & still their not happy still THREATENING MORE ACTION!! Something needs to be done here I know all cases are different but my husband didn’t just abandon his son she forced him out!!!

    If vindictive PWCs (i am only talking bout the vindictive ones here, not the fair, reasonable pwc’s) then maybe they would change their tune, and stop using children as cash generators and weapons of crass destruction.

    Maybe, just maybe children would get to see BOTH parents if THEY wanted. And if NRP really was an abusive, negative influence, then you wouldnt care about the money, you would just be glad your child was not going to be harmed. Well I would.

    As it stands now, PWC can dictate the terms on whatever whim they are feeling. Got a new partner….well you dont get to see your child and I will set the CSA on you!

    I agree with you OP…if you are willing to pay, but are still not allowed to see child, then you shouldnt have to pay. But this culture is about breeding resentment, creating greed, which promotes the breakdown of parent/child relations. I truly believe our governments do not want healthy, stable couples (whether together or not) co-parenting maturely and effectively, their children. Because that means children grow up balanced and secure and confident.

    Balanced and confident adults are harder to control, market shite to, and do not take kindly to being bullied by ego maniacs in government.

    If we are all healthy beings we do not need governments, its that simple. They need us and our £££ though….so this cycle will spin a few more rounds yet…

    Have the CSA obtained a Liability Order for the £7000? When your offer was made to pay the arrears, was the offer put in writing?

    Yes sheriff officers came to our door with a liability for the arrears & put it against our house, now their threatening to take his license??? Absolutely unreal, bloody home wrecker’s that’s what they are, we could end up in financial difficulty while she has emigrated to Australia & live the high life!!!

    I can only offer my empathy Lynne. This is what happens when money comes before family. They do not care about peoples lives and livlihoods being trashed. It really does not make financial sense, either, as surely taking a smaller regular payment would be better than forcing someone to lose their job, and become a benefit claimant, where the minimal flat rate of £5 would be taken from their benefit. Surely someone in employment putting back into the (corrupt) system albeit not the desired amount, is better than adding to the welfare deficit?

    I wonder if they get off on all the power, because like playground bully boys, they would rather the target not have any dinner money to give them, so they could ‘justify’ kicking him to the ground.

    I hope a solution comes about for you and your family Lynne.

    Seriously I’m sure they make it up as they go along, your statement – “They are chasing my husband for over £7000 arrears & we don’t know where they get their figures.” makes me very suspicious.

    Ever since the last government brought the country close to bankruptcy and the current government brought in ‘austerity’ measures there seems to have been a surge in the number of ‘arrears’ claims by the csa.

    In my case they claimed ‘arrears’ for a period I wasnt working, when they knew I wasnt working. They tried to twist the rules to claim they did not know, that they were not informed etc etc. My data prints showed they were talking rubbish, Court of Appeal here I come.

    In another case the ‘dodgy’ practice of ‘inventing’ arrears by the csa was shown up in all its glory:-

    “chall on January 30th, 2013 7:43 am – There was a case on here a while back where a letter in a DP file, the the NRP never received, had the NRP’s correct address on it, but the date was way before the NRP had even moved to the address (can’t remember which member it was – sorry).- does everything tally on yours ?”

    The result was so called ‘arrears’ for the NRP.

    Do you have your data prints? It should show in there where your ‘arrears’ come from. Here is some general information of action you can take:-

    ‘This isnt the csa its an open forum so don’t give names/details etc especially of children. (your own name can be used to identify the kids, and your case)

    Don’t deal with the csa by phone, everything in writing, sent recorded, keep the receipts.

    Copy your MP into everything and try and get them involved as your advocate.
    Make a formal complaint about any decision you are unhappy with from the outset as time limits are involved. Always go for an appeal tribunal asap following the internal process.

    Get a copy of your Data Protection prints from the outset so you know what you are dealing with, again follow the correct procedure in wording your request to get ALL information, send it to the right department, send the correct fee.

    Don’t be afraid to complain about any csa staff, or their superiors if you feel you have just cause.

    Remember the process, internal complaint, ‘independent’ case examiner (the csa protection department), appeals tribunal, parliamentary and health service ombudsman through your mp for maladministration.’

    Read the various threads on here eg ‘Court ruling leaves child maintenance authority ‘emasculated’ – ‘November 1, 2012′ (you dont have to prove you dont owe the money, they have to prove you do)

    You may pick up some useful info.

    Finally a specialist csa solicitor may be worth talking to but can be expensive and usually end up putting you in touch with a specialist barrister. Still worth an initial interview though but to reduce costs you can use a ‘direct access’ barrister (find through internet) and save on solicitor costs.
