The CSA are trying to take wages I never even recieved

I’m on a temporary contract at work and I’m rolling on a 3 month basis. In October we were asked to drop our hours from 36 to 28 and a half, we got our 36 hours back in Feb.

I got paid and realised they took a huge amount – £565, normally its 393 a month. I asked my employers about this and they said the CSA are taking the arrears from october. How can this be when i didn’t even earn this money? Also they said nothing to me in October because i phoned them and told me it was OK because i had protected earnings…they lie, and deceive people, callous system.

    Robert:- Did you ask for a reassessment in October due to your reduction in income?
    If you did and they have not done it yet you need to complain and ask them to complete the reassessment dated back to October.
    As you called them in October “you must have told them about the reduction in income” the implicit reason for your call being a request for a reassessment.
    If they can not collect the full amount because of protected earnings they will offset the missing amount to arrears for collection at a later date.

    This is happening to me right now. For years, Every year I ask the CSA “Am I paying the correct amount” and “Why is there a break in March”. They also sent me letters “clearly stating” how much I need to pay each month and I have paied EXACTLY what they told me to.

    I just got made redundant and now they are chasing me for £400 worth of arrears… what?

    I asked how they came to this conclusion and what I got in the post was a list of payments due and what I paid… oddly “Some” months in 2010, they are charging me for a “5-6 week month”… hang on??? What they are doing is “rounding up” the weeks, so for example even if the beginning of the month is on a Sunday or if the end of the month is a Monday, they round it up to a week, even though its actually ONE DAY! and change me a weeks Child support!!!

    I am seeking legal action.

    Lee – your maintenance will charge on a specific day in the week, this is set by the initial effective day, which in turn is set by the day the CSA initially contacted you at the start of the case. As such if for example they first made contact with you on a Tuesday, your weekly liability will charge every Tuesday – so if there happens to be 5 Tuesdays in a particular month you will have 5 weekly charges that month. If your check your statement charge dates back to the start of your case you should have 1 charge every week from the start date to present
