My ex’s payments now go to the state – this is ridiculous

Me and my ex husband have been with the csa for a least 10 yrs now, we are under the old system still and payment to me come in as and when csa decide to pay out, even tho my ex has proven he pays weekly.

My payments often get stuck on their secondary system and left there so csa said he had to ring up daily to remind them, running up my phone bill. So I been doing as they asked, still getting irregular payments. I also asked why I always get different amounts, I have done for years now but like they keep telling me its what my ex owes me. That was before Xmas, now I get a letter to say they overpaid me by thousands and even tho my ex has to continue paying each week instead of it coming to me it will all go to Secretary of State!!

Now I’m lost, I never knew wat his income was or what his expenditure was, csa did all the calculations since day one and finalised what I was entitled to, even after several re assessments, and surely it would go back to him not state. They say its new legislation come out this yr but I’ve had no correspondence, no letters no nothing til I pulled them…..been told cant appeal, can’t ring to discuss it, he has to keep paying to state, I’m not allowed it at all. Where do me or my ex stand on this, he paid me not state so why is it not going to him if he’s overpaid me.

    I had the same problem. Took years to sort out. And you can appeal. It basically comes down to what benefits you were on. Get your data file of them. Think they charge £10 for it but it is worth it.
    Don’t give up. Make every communication with them by letter. Never ring or speak to them over the phone.
    Having a paper trail always helps because they not only give inaccurate information over the phone they also do it by latter as well.

    I have two boys and I am meant to pay 16% of my gross earnings, as I am with the Child Maintenance Service. My earnings have never changed and I have a payment schedule that totals I should pay £1200 more in a year than what 16% actually totals. I have called and emailed through their portal to be told “We’ll get it out in writing to you…” when it still doesnt explain the difference! Also to make matters worse, they say I am in £700 arrears – when I have never missed a payment or been short?! How can I get answers and this resolved!
