Is she allowed to claim so much if I’m left with just £3 a week?

November 5, 2013

Hi I’m getting mixed answers so coming in here to hopefully get a better view

Ok my ex wife I pay half a joint mortgage of 338 a month Csa want 311 off me but this is also so much cause they have not had all my details I sent them

Anyway talking to colleagues in work they asked how I was so I said bit down explaining finances my ex claims something which I think is single parent something she gets about 568 a month working tax/ single parent I think also with 136 child benefit and now 311 plus I pay half the mortgage 338

Is she allowed to claim so much I am left with 3 pound a week and I can’t pay rent

I’m so worried can anyone help me in advice ?

Have you told csa you are paying half the mortgage?
As long as you have no stake in the former home you should be able to offset this against child maintenance or stop paying half the mortgage….you ex cannot have her cake and eat it, really greedy if you ask me…I’m shocked she put a claim into csa and not expect you to also have outgoings?

Make sure you write a letter to the csa with proof of mortgage payments and tell them its leaving you in hardship whilst paying both….might be worth seeing your mp too to give the csa a kick up the ass!!

    Ask http://www.nacsa.co.uk to help.

what sh*t situation for anyone to love, marry then have children and have your loved one screw you over.

Jo is correct I suggest that you google Bird v Secretary of state. 2008 the case was heard in the high court so has substantial authority.

I would suggest that you make a formal complaint and after reading the afore mentioned case mention it to them.

They are well aware of the case

    Good luck
