I want the bank charges back caused by the CSA not paying on time

November 18, 2012

For the last 16years i have dealt with the CSA over my daughter… It has cost me 100’s of pounds in phone calls to chase up payments that have not turned up and endless bank charges… after the first 6 times of calling and chasing why my payments hadn’t been paid into my bank account and speaking to one of the main people.. It came to my attention that payments had been paid in but the administration team hadn’t allocated it on to the system for payment… I have heard every excuse going that the parent hasn’t paid, when they had…

Even today as i write this my payment which is now monitored hasn’t hit my bank account which should have arrived in on the 4th of november… It is very annoying.. i haven’t any credit on my phone to call them and no letter to say that the payment will be late.. I could scream with frustrationg as i have had to keep changing my direct debits.. which i add have changed a thousand times..

even working a month in front of them to make way for any late payments from then and still it is happening.. it is time the agency started to compensate others like me for charges on bank accounts and started thinking of the children a little more instead of holding money in their accounts to gain interest off all the payments fathers pay in… come on CSA time to get things right…

16years and still the same old crap..all though i have fine tooth combed every call and spoken to those in authority..and it always comes down to the same thing .. father hasn’t paid..but then i find out they have and CSA have it sitting in their accounts gaining alot of interest..

Time to give some of that interest back to the parent eg like me. who ends up with bank charges because CSA hasn’t paid in on time . I think i will go to my mp to..because my account is monitored to ensure it goes in on time..and now in november 2012 16years down the line and still getting no letter to confirm none payment or should i say .. their staff haven’t updated it on their system for payment which 9/10 is the CSA’s administration fault.. sick of the lies .. and the cover ups ..

Time us mums or single fathers got together to get back what the CSA owe us in charges over the years..let alone the absent parent…

As the service is so poor I recommend you close your case and come to a private arrangement.

If you have suffered an actual financial loss because of the CSA, it may be appropriate to request an Ex-gratia payment.

You would need to make a complaint and although there is no legal right to such a payment, it may help if you make it clear that financial compensation would help resolve the complaint.

CSA would probably say it is not their responsibility if you end up with bank charges as your Bank account will be your responsibility. If there are insufficient funds very little the CSA can do.

You could complain to the Agency about not receiving the payments and finding out why they are not passing any maintenance to you.

the account the CSA have into which payments from Non-resident parents payments are made is a non-interest paying account.

there could be several reasons that the money is not allocated to your case, if it is paid by cheque and there is no National Insurance no on the cheque the banking team will not be able to identify which case the money is to be paid to. If it is paid as a bulk payment from an employer and the breakdown total does not match the exact amount of the payment then the employer will need to re-submit the breakdown so that the correct amount of money can be allocated to each individual case.

The CSA advise all Parents with Care that they cannot guarantee any payment so it is unlikely that you will be awarded compensation for any bank charges you have incurred

They can however guarantee taking it from the NRP at the correct time via DEO, what happens then is open to interpretation!!!!
