How can CSA justify its mistake?

I have a massive problem with the child support agency, to briefly explain I pay csa to my ex mother in law to support my 16 yr old son have done for 2 years, since we mutually decided he would stay with her.

She has recently been putting me down to my son sayin csa is not being paid although it is deducted from my wages each month, his father also doesn’t live in the same house as my son but his nan could decide who she claimed off and I was easy target cos I work which I think is wrong in itself we both are responsible for a child we had together but anyway that’s another story.

I got fed up with this and decided to contact csa myself. no payments have been made to my ex mother in law since may 2013 I pay £144 per month csa looked into this and found that thru a ‘clerical error’ they have been paying the money into my ex husbands bank account (I assume they used a ref number from a case I had with him that ended 8 yrs ago as my oldest son now is 24).

CSA have informed me that unless my mother in law agrees to the deduction of earnings that is in place to be stopped the money will continue to go into his account, he has kept it quiet for 5 months that he has been receiving this money in error knowing that his mother has not been receiving payments and pretending to ring csa for her then telling her it is because I am not paying.

He was found out yesterday and his mother wont have it that he has done anything wrong, csa say they will recover the money from him but because he is in receipt of benefits it will be £2 per week in the mean time money that should have been supporting my son is awol and he has gone without for months tho I have bought him clothes and trainers given him money etc because I felt guilty that for some reason csa was not passed on.

CSA have also informed me that while these payments are outstanding I will stay in arrears of 5 months, I have asked csa for answers such as how can they make this mistake, I was told it was the computer then I pointed out to them computers are operated by people, I want answers as to what they are going to do about future payments, how can they make this mistake, how can they justify a child going without when csa is suppose to be all about supporting the child.

I also want to know are they going to open a fraud case as my ex husband did not delare this money to other benefit agencies such as hosuing benefit and job seekers, but I am getting nowhere.

    I would see you mp on this one. Don’t feel guilty if you have been paying, sounds to me the monster in law thinks the sun shines out of her sons ass! You have the proof you’ve been paying and that’s all that matters.
