what happens when 1 child lives with each parent?

    I have 2 children 16&15 who until now lived with their mum and husband locally and I paid maintenance in a private agreement. Everything has been (and is) amicable.

    My son 16 has decided to live with me and my wife and moved in last week. He is sure he wants to stay. The initial discussion about money with his mum&husband was when we told them he was leaving so we all felt a bit of pressure. They said they would be happy if I halved the amount I pay and I nodded as I didn't want to cause more friction at the time.

    I now need to sort out what to do. I probably earn a similar amount to mums husband although she doesn't work. (my wife also works so as family we certainly earn more).

    What would CSA work out (approx obviously) in this situation? I do not expect it to ever get to CSA and I will still pay some money for other child as I want to make sure she is supported but this will help me decide how much.

    Finally I also was going to let her keep all child benefit but thinking about this could that open her up to fraud? If so I will need to claim that and adjust the amount I pay accordingly.

    All factual info greatly appreciated :)

    You need to claim the child benefit. If it is not in payment to you then your son cannot be considered a relevant other child for purposes of the CSA calculation..

    The CSA would take your net income. Then they deduct 15% for your son. 15% of what remains is your maintenance calculation. This amount will be reduced if your daughter stays overnight with you on a regular basis. For example if she stayed on average one night a week, the maintenance would be reduced by one seventh.

    You could also take out a role reversal case ie you claim against your ex for money toward your son, but as she does not work, this would result in a nil assessment, so probably not worth doing.
