THE CSA ARE THREATENING TO SELL MY HOUSE AND MAKE MY CHILDREN HOMELESS

    I need help, the CSA are threatening to force the sale of my house unless I pay £3700 in the next 14 days!! I have recently lost my job but up to that point I was paying my CSA every week, I am now paying whatever I can every week and yet they still want to sell my house. I have a girlfriend and 2 kids and 1 on the way and the CSA tell me that they don't matter and I shouldn't have had any more children as I should be providing for the 2 that I had with my ex wife,(even though she lives in a 4 bedroomed house and is driving a new car and yet I'm struggling to buy gas and electric). When I received the liabilty order for £7k, I borrowed £4k from my parents and paid it straight to CSA and they still put the charging order on my property, I don't know where to turn as even if the CSA force the sale of my house, they still won't get a penny as my house is in negative equity and is worthless, in fact I would be left with a debt of £20k just from my mortgage provider and then the CSA would take away my driving license or send me to prison and my children and myself would be on the street.
    Please I need advice.

    If you look on www.deadbeatdads.co.uk there is a section on your worry.Dont quote me but i think you have to ask the land registry for a copy of the charging order and see if its signed.Apparantley they are not signing them which makes it null and void.Something like that anyway.check out deadbeats site they can help you.I suppose i should say check out other sites too in case im accused of being something to do with this site.They have helped me so its worth you looking,Good luck

  3. Due to the agency 2 year steer a starting point for negotiating debt is to require full repayment immediately.If it is not possible then the aim is to secure an agreement that will gain full recovery in the two year period.

    Decisions regarding enforcement of maintenance are discretionary. Each case should be considered on its own merits.
    If a NRP has nil income and can not currently afford to pay the arrears, agency staff as per their procedural guides, can make arrangements not to pursue arrears at this point, and arrangements can be made to contact the NRP at a future date to re negotiate the payment of such.

    The solicitors for the agency would decide whether or not to proceed with an Order for Sale. They will consider equity in the property. If your share would not be enough to pay the debt, its doubtful they will proceed.

    I have now spoken to Fairfax solicitors (previously known as Eversheds) and they said they would accept £40 per week and that would stop legal proceedings, I explained that I'd lost my job and could only afford to pay £20 per week which I have done and am currently doing and yet I am still getting threatening letters and now threats to send me to prison even though I am not refusing to pay and have stated this several times on the phone, via email and via letter but apparently they have to have the arrears within 2 years and better still have recently discovered that my ex will not be getting a penny of it as the CSA had overpaid her and now want me to pay it back!!!!

    First of all the CSA cant force you to sell your house if your partner is living with you with your other children. Have you told them that they are living with you in the same house.

    The lender who you owe the mortgage to has first charge and they get there money first you say you are in negative equity so do you think CSA dont know this they would have asked a valuer what the house was worth. This is just a scare tatic.

    If you are not working then your assessment is nil. You havent said how long ago your assessment started. You might not have needed to pay what they said in the first place. How old are your children to your ex wife and what are her circumstances, does she have other children, is she living with someone. This would be interesting to find out as it seems as though child support know that you are scared of them and they are treating you very bad.
